Sheehan Lobbied Congress With 501c3

As noted below, Cindy Sheehan’s agitprop Gold Star Families For Peace claims to be a tax-exempt 501c3 charity:

Searches of the IRS and commercial sites like GuideStar turn up nothing to indicate that this is true and that Cindy Sheehan has gotten tax exempt status for her Anti-American activities. Of course this is standard practice for the Hate-America industry. Even the Castro-worshipping Veterans For Peaceclaim to be a 501c3.

But if Cindy is not violating the law by claiming to be tax-exempt when she isn’t, she is violating the law by using this group to lobby and campaign.

Lobbying Activity

In general, no organization may qualify for section 501(c)(3) status if a substantial part of its activities is attempting to influence legislation (commonly known as lobbying). A 501(c)(3) organization may engage in some lobbying, but too much lobbying activity risks loss of tax-exempt status. 

Legislation includes action by Congress, any state legislature, any local council, or similar governing body, with respect to acts, bills, resolutions, or similar items (such as legislative confirmation of appointive office), or by the public in referendum, ballot initiative, constitutional amendment, or similar procedure.  It does not include actions by executive, judicial, or administrative bodies. 

An organization will be regarded as attempting to influence legislation if it contacts, or urges the public to contact, members or employees of a legislative body for the purpose of proposing, supporting, or opposing legislation, or if the organization advocates the adoption or rejection of legislation.

Political Campaign Activity

Under the Internal Revenue Code, all section 501(c)(3) organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office.  Contributions to political campaign funds or public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate for public office clearly violate the prohibition against political campaign activity.  Violation of this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise tax.

Zeese: Describe some of the projects you have pursued?

Sheehan : We are lobbying Congress to have an inquiry into the lies that caused Iraq. We are trying to meet with the Sec of Defense to hold him accountable for the lies. We campaigned against George Bush during the elections. We are working on Counter-recruitment. We work closely with the AFSC’s Eyes Wide Open Exhibit and the VFP’s Arlington West.

Zeese: What are some upcoming events?

Sheehan : We are walking the halls of Congress on June 15th to push the Resolution of Inquiry into the AfterDowningStreet.org request and and inquiry into the lies and betrayals that killed our sons and daughters.

Dissident Voice

In this instance Cindy is actually telling the truth. For example, Cindy and her "co-founders" of GSFP were the only people in this anti-Bush ad giving voice to "real Americans." (This ad was financed by George Soros and done by Cindy’s PR firm, Fenton Communications):
