DA in Duke Rape Case Asks to Be Taken off Case


Jan. 12, 2007— District Attorney Mike Nifong has requested that he have himself removed from prosecuting the Duke Lacrosse rape investigation, ABC News has learned.

A source close to the investigation said Nifong sent a letter to North Carolina Attorney General Roy Cooper asking his office to assume responsibility of the case. Calls to the Attorney General’s office and Mike Nifong’s office were not yet returned…

Of course this is just the beginning of what should happen to Mr. Nifong.

It’s probably just a coincidence that the trial date for his ethics hearing was set today.

Prosecutor Mike Nifong Removed From Duke Case

(CBS) RALEIGH, N.C. The state attorneys general’s office says it will take over the Duke lacrosse sexual assault case at the district attorney’s request.

“I wish I could tell you this case would be resolved quickly,” Attorney General Roy Cooper said. “Since we have not been involved in the investigation and prosecution, all of the information will be new to our office. Any case with such serious criminal charges will require careful review.”

Facing ethics charges that could lead to his disbarment, beleaguered district attorney Mike Nifong had asked that a special prosecutor take over the case.

The announcement of the request came two days before an interview with the forensic expert in the case was to air on 60 Minutes, in which he acknowledges he made a “big error” in his judgment by not stating in his report that the only DNA he found on the accuser was from several men who were not on the Duke lacrosse team.

It also came one day after court papers filed by defense attorneys stated that the accuser in the high profile case told prosecutors in December that one of the three players charged did not commit any sex act on her during the alleged attack…
