ACORN Training Foreclosure Squatters

From Baltimore’s CBS affiliate WJZ:

ACORN Trains Citizens To Protest Home Foreclosures

by Derek Valcourt

February 19, 2009

BALTIMORE (WJZ) ― A community organization breaks into a foreclosed home in what they are calling an act of civil disobedience.

The group wants to train homeowners facing eviction on peaceful ways they can remain in their homes…

Near Patterson Park, the padlock on the door and the sign in the window tell part of Donna Hanks foreclosure story.

"The mortgage went up $300 in one month," said Hanks, former homeowner.

She says the bank refused to modify her loan and foreclosed, kicking her out of the house in September.

The community group ACORN calls Hanks a victim of predatory lending.

"This is our house now," said Louis Beverly, ACORN.

And on Thursday afternoon, they literally broke the foreclosure padlock right off the front door and then broke into the house, letting Hanks back in for the first time in months.

"We are actually trespassing, and so this is a way of civil disobedience to try to stay in the house," said Beverly. "Legally it’s wrong, but homesteading is the only means that she has left to stay in her house. And we feel as though this is the right thing to do at this particular time to save this family."

Inside, there’s spray paint on the walls and evidence that someone has possibly been remodeling.

The group says it was staging similar demonstrations in six other cities nationwide while urging a moratorium on foreclosures. They want that until President Obama’s stimulus plan begins on March 4. The plan is designed to help threatened homeowners.

"As you all can see, Donna is reclaiming her home, and she’s putting a lock on her door at this time," said Beverly.

But that padlock won’t stay there for long.

Not that there is no mention of any criminal charges being brought anywhere in this report.

We are just supposed to accept this as ‘civil disobedience,” and political speech. (Meanwhile, real political speech is being outlawed.)

Luckily still more billions of dollars are on their way to these ‘community organizers’ so they can increase their noble work.

Welcome to the third world.

By the way, what these people are doing is specifically prohibited by the IRS  guidelines for taxpayer supported 501c3 “charities” such as ACORN:

(1) Substantiality Test

Violation of constitutionally valid laws is inconsistent with exemption under IRC 501(c)(3). As a matter of trust law, one of the main sources of the general law of charity, planned activities that violate laws are not in furtherance of a charitable purpose. "A trust cannot be created for a purpose which is illegal. The purpose is illegal … if the trust tends to induce the commission of crime or if the accomplishment of the purpose is otherwise against public policy…. Where a policy is articulated in a statute making certain conduct a criminal offense, then …, a trust is illegal if its performance involves such criminal conduct, or if it tends to encourage such conduct." IV Scott on Trusts Section 377 (3d ed. 1967). Thus, all charitable trusts (and by implication all charitable organizations, regardless of their form) are subject to the requirement that their purpose may not be illegal or contrary to public policy

(4) Planning Illegal Acts

Not only is the actual conduct of illegal activities inconsistent with exemption, but the planning and sponsoring of such activities are also incompatible with charity and social welfare

But as we have long since learned, ACORN and their compadres are above the law.

After all, they are simply doing the bidding of their DNC masters.

Was this part of obama’s training sessions when he worked with ACORN???

The brazen audacity of these folks is amazing! Course, I guess that’s what happens when you “legitamize” thuggery .. as well as endorse it and fund it!

Would it be silly to question how the investigations on this group are going??? Probably.

We used to be a nation of laws. Now look. See what affirmative action applied to the highest office in the land gets for you. As a taxpayer, you are subsidizing this behavior, abortion-on-demand, stem cell research, free hospital care and in-state tuition for illegals—oh, it’s a glorious and lengthy list. When will you say “Enough”!?
All of this is now the law of the land and sanctioned by your president in the name of ‘spreading the wealth around’.

Bad times a’comin’, folks! What are you willing to do about it?

    They are going too far.

  3. Rusty Shackleford says:

You heard it here first on S&L.

“If you won’t let us have it, then we’ll just TAKE it”.

And it only took a month.

(Actually much later than I thought it would)

  4. caligirl9 says:

    Predatory lending?
What ever happened to “just say no” if you can’t afford something!
    More like predatory borrowing …

Slowly but surely, the outrage will trickle down. There has to be more of “us” than “them”…

    Maybe OT but then again?
Think back to the summer before 9/11/2001 that would have been when they were still trying to get rid of Holder and his cronies. All we herd was about racial profiling this and that. I’m sure there are smarter people than me that can put some of this stuff together. Then think about all them OTM with this democrat open border.
For me see 2&2 still =4
I believe this is what the bho team want to gain even more power the Rape America bill is just part of it.
ACORN is part of the brown shirts

What this is. Is breaking and entering which in most states is against the law. Go to jail do not collect 200 dollars.

  6. The Redneck says:

Here’s where we need the city government to show some balls. Have the police hunt down and arrest everyone who not only broke into a house but was arrogant enough to do it on film.

Then, when you shove that main yagov into a cell, tell him “This cell is yours now. “

“Legally it’s wrong, but homesteading is the only means that she has left to stay in her house.

Homesteading??? It is called breaking and entering where I live.

I think you can still legaly homestead in Alaska, maybe this deadbeat ought to try it up there.

  8. pdsand says:

Legally it may be voter fraud, but it’s the only means we have left to continue to get our guys elected.

  9. canary says:

Obama’s new trained ACORN infantry needs barracks. We allready know the higher ranking officers in the new army, but now we have seen his new trained infantry in action. All ollah Obama’s talk about more federal workers. ollah Obama won’t even have to hand out job applications. Obama’s halt of foreclosures will last until he can move in his new regime ACORN gestapo.

  10. wardmama4 says:

This is illegal and these ACORN people should be arrested and in jail. It is the start of anarchy if they are not arrested and put in jail – as it is government acceptance/tolerance of crime to justify a government program. Take a look just about all of these definitions apply:
    * “No rulership or enforced authority.”
    * “Absence of government; a state of lawlessness due to the absence or inefficiency of the supreme power; political disorder.”
    * “A social state in which there is no governing person or group of persons, but each individual has absolute liberty (without the implication of disorder).”
    * “Absence or non-recognition of authority and order in any given sphere.”
    * A society free from coercive authority of any kind is the goal of proponents of the political philosophy of anarchism (anarchists).
    * Independent from rule or authority.

wardmama…sounds like the same rules the illegals follow too, with the same result. No, the only people subject to laws and arrest will be people like us. The rest will be free to do as they please, because they worship the messiah. It is fast becoming time to act in the defense of this nation.

  13. U NO HOO says:

I’m too old for this crap.

PS, wasn’t Pineapple Princess Nancy Pelosi’s father mayor of Baltimore?

    I’m just aksing?

  14. curvyred says:

Nice to know our tax dollars are financing these kind of behaviors.

I really do think liberalism is a mental disorder, the house does not belong to ACORN or the former occupant – it belongs to the bank now.

  15. 12 Gauge Rage says:

When you sign the papers for your house or even an apartment it clearly states the terms of late payments and the consequences related for failure to pay. This is insane. Obama and Brownshirts are clearly breaking the law but don’t really care. Now all that remains is to see just how far this will go. Will Obama one day think that his Brownshirts aren’t tough enough and form his own ShutzStaffel (SS Protection Staff). And then have his own version of the Night of Long Knives to liquidate the Brownshirts after they’ve served their purpose? Our tax/extorted dollars hard at work for you.

  16. DoctorRock says:

I may be rushing to judgement here, but isn’t this one of those “The whole country’s watching” moments? Where’s law enforcement? Isn’t being incarcerated for your beliefs a big part of “civil disobedience”? This isn’t even Illinois!

    • JohnMG says:

Oh for the days of Janet Reno…..when federal troops with CS tanks and a whole host of swat teams would descend on the “compound” and render it a pile of smoldering ash.

Guess we won’t be seeing any of that any time soon, huh?

  17. 1laidbackRN says:

I guess ACORN is just preparing for the nationalization of the banking industry, whereas, they will consider all foreclosed homes to be in the federal housing program.

It makes me sick what these POS are doing to this country.

  18. canary says:

they allready did this in 6 other states? Probably they all didn’t have the Make My Day Law. When the previous owner smiled and said it’s been totally stripped, they should take fingerprints and show it was her. It’s been in the news that people are stripping their homes before leaving, to include taking airconditioners, ruining pipes. She could have gone on a badly needed diet, part time job, rented to someone else who’s lost their home, until Acorn helped them remortgage. But, I’ve noticed some decide they can’t pay the mortgage and don’t mind losing their homes, but stay as long as they can, or done something to get the extra cash until she could get a new mortgage. And Acorn Bevery called it “our home”.
Neighbors were probably to afraid to call police?

  19. GuppyNblue says:

Well this should reassure us that Obama will resolve the mortgage crises. How are the people holding these bad assets going to deal with them when Obama’s street thugs are stealing the property? The stimulus money is supposed to help bailout those who have fallen behind on their mortgages but this woman doesn’t own the mortgage any longer. So we’re subsidizing those that couldn’t afford their houses (not allowing the real estate market to adjust itself) and Obama’s street thugs are stealing property that someone else holds the debt on.

But IMO, it wasn’t meant to work. It was meant to cripple our economy and spread the disease of Marxism. I live in Baltimore and know this woman’s kind a thousand times over. There’s a host of government programs that will support her throughout her life and she needn’t make any effort to improve herself. It’s when you want to make an honest living that the government starts putting demands on you. Is there any doubt that this is a recipe for failure?

BTW, where are the police and will anyone bring charges against ACORN? Scary point SG.

  20. BillK says:

Why would the Police go after these people?

Not when that might possibly endanger their funding coming from “stimulus” packages.

    • TwilightZoned says:

Good point Bill. How many other agencies are going to be held hostage by steal-from-us money? And at some point is there going to be full blown anarchy due to The One’s inability to control the monsters he’s helped create?

    An update from Fox News:

Arrest Made in Home Foreclosure Civil Disobedience Program

    Monday, February 23, 2009
    By Joshua Rhett Miller

Police in Baltimore today made what is believed to be the first arrest in a civil disobedience program aimed at supporting homeowners who refuse to vacate their foreclosed homes.

An activist with ACORN — the Association of Community Organization for Reform Now — faces criminal charges after breaking into a home in southeast Baltimore on Thursday to protest the foreclosure crisis sweeping the country.

“This is our house now,” ACORN member Louis Beverly reportedly said after cutting a lock with bolt cutters at the home.

Beverly will be charged with fourth-degree burglary, according to Anthony Guglielmi, a spokesman for the Baltimore Police. Attempts to reach his attorney, Justin Brown, were not immediately successful.

Donna Hanks, who owned the home since 2001, lost it in September when she couldn’t make her $1,995 mortgage payments. It was not immediately clear whether Hanks re-entered her home last week, but she was not expected to be arrested, Guglielmi said.

Other police departments contacted by FOXNews.com said arrests would be made if an individual is determined to be residing at a foreclosed home illegally.

“If they’re trespassing and it’s not their property, absolutely, there’d by an arrest,” a police source in Boston said. “If they were told to leave the property and they didn’t, they’d be charged with disorderly conduct.” …

Maybe we are cynical. But we suspect this is just being done because of all of the current attention.

Once the heat is off, the authorities will continue to turn a blind eye.
