SAN DIEGO – Ousted Agriculture Department employee Shirley Sherrod said Thursday she will sue a conservative blogger who posted a video edited in a way that made her appear racist…

Gee, we didn’t see this coming. Except that Ms. Sherrod has gotten to where she is today by way of lawsuits.

Speaking Thursday at the National Association of Black Journalists convention, Sherrod said she would definitely sue over the video that took her remarks out of context. Agriculture Secretary Tom Vilsack has since offered Sherrod a new job in the department. She has not decided whether to accept

As we have previously noted, her attorneys must decide how much taking the job will undermine her case. Since she will not be able to show that she has suffered any obvious damages from Mr. Breitbart publicizing the YouTube video of her speech.

So Ms. Sherrod has to calculate whether she will make more money from her lawsuit than she will from her new “job” at the USDA.

Sherrod said she had not received an apology from Breitbart and no longer wanted one. "He had to know that he was targeting me," she said…

Ms. Sherrod and her lawyers may want to review the landmark libel case of Sullivan v New York Times, which set the bar quite high for such lawsuits, especially lawsuits from public officials.

At the very least Ms. Sherrod will have to prove “actual malice,” which the court described as actual knowledge of falsity, or reckless disregard for the truth. None of which is likely to be provable insofar as Mr. Breitbart merely re-posted a YouTube video of her remarks.

At the journalists convention, Sherrod was asked what could be done to ensure accurate coverage as conservatives like Breitbart attack the NAACP and other liberal groups.

What a laughable question. And notice that these purported journalists (and the AP) are trying to find ways to control the news media and to punish their ‘fellow journalists’ for publishing information that hurts their agenda.

We have gone completely through the looking glass.

Sherrod, 62, responded that members of her generation who were in the civil rights movement "tried too much to shield that hurt and pain from younger people. We have to do a better job of helping those individuals who get these positions, in the media, in educational institutions, in the presidency, we have to make sure they understand the history so they can do a better job."

She said Obama is one of those who need a history lesson.

"That’s why I invited him to southwest Georgia. I need to take him around and show him some of that history," Sherrod said…

"Young African-Americans, young whites, too, we’ve done such a job of trying to be mainstream that we push things under the rug that we need to talk about. And then we get to situations like this," she said…

Ms. Sherrod is absolutely right. We have not talked enough about civil rights or the history of the ‘civil rights movement’ in this country.

This is a subject that is almost never taught in our schools or ever mentioned in our popular culture. Our media and political leaders never bring our country’s shameful history of racism.

We have to get the word out that once upon a time in this country some blacks were discriminated against. And once the word finally gets out, we will have to start to do something to make reparations for all that secret, silent suffering.

And certainly all of this would be news to Mr. Obama, who has obviously never thought about racism or racial reparations at any time in his entire storied life.

    Sherrod plans to sue Breitbart

    (CNN) — Former Agriculture Department employee Shirley Sherrod said Thursday she will pursue a lawsuit against conservative blogger Andrew Breitbart.

    Breitbart posted an edited video clip of Sherrod appearing to say she discriminated against a white farmer looking for assistance. The clip showed her addressing a chapter of the NAACP.

    “I will definitely do it,” she said when asked whether she was considering legal action. Sherrod made her remarks during an appearance at the National Association of Black Journalists convention in San Diego, California.

    Breitbart “had to know that he was targeting me,” Sherrod said. “At this point, he hasn’t apologized. I don’t want it at this point, and he’ll definitely hear from me.”

    Breitbart did not immediately respond to a request for comment. He has said he released the Sherrod video because he believes it shows the NAACP itself tolerates racist behavior within its ranks — an accusation that came after the civil rights group made a similar charge against the conservative Tea Party movement.

    “This was not about Shirley Sherrod,” Breitbart told CNN’s John King.

    Brent Bozell, head of the conservative Media Research Center, said Thursday Sherrod was the one who needed to apologize.
    “Andrew Breitbart is going to be fine. He’s done nothing wrong,” Bozell said.

    “I wonder if Ms. Sherrod, who is such a champion of transparency, will publicly disclose who is putting her up to this. And I also hope this champion of honesty will stop lying about Fox News,” which has been accused of pushing the story before full details emerged, he said.

    I’m also waiting for Ms. Sherrod to publicly apologize for accusing anyone opposed to nationalized healthcare of being racist,” Bozell said. “Last time I checked, that was more than half the country.” …


    Hmmm, does this mean that Bush can now sue CBS? Does this mean every Republican can sue… well, all the news networks?

    Anybody notice that Sherrod has fallen off the cliff as far as the msm is concerned.

    Don’t suppose it could have anything to do with her interview on a Sunday msm show where she revealed just how virulent a racist she is. Among a litany of moonbat proclamations, she (in public) accused Breitbard of wanting to go back to the days of slavery.

    I wonder why the dingbat ‘graduate degree candidate’ who was defending the racist queen hasn’t jumped back in to brag about that?

    Sherrod Can Not sue Breitbart.

    Sherrod would have to sue her Boss and/or the President of the U.S.
    No due process, and they violated her civil rights discriminating against her.

    1. They did not have a formal discussion and hear her side of the story

    2. They did not give her a letter of warning.

    3. She claims “They” intimidated & harrassed her into resigning.

    QUESTION: Did the President Obama & Boss allow her Union Representative with her during the discussion, which I guess in this case would be the NAACP & several others. tsk tsk. Obama knows one should have representation when being fired or disciplined.

    4. No harm was done to Sherrod, because she was praised by The king Obama and the king offered a job. If she doesn’t take it, she has harmed herself. If she feels uncomfortable to work for Obama & her boss, after their unfair treatment she should sue them.

    9/ Breitbart showed a video Sherrod admitting to have felt racism towards white people, and the reaction of the NAACP clapping & hooting, praising
    Sherrod for her racism. Did Sherrod get angry and tell them to stop. Did Sherrod stop her confession? She willingly admitted to the public, and it is what it is. A glimpse into the NAACP acting like they were in Rev. Wright’s church.

    Attorney: Ms. Sherrod, did Mr. Breitbart fire you? Did Mr. Breitbart order you to resign?

    Sherrod: No no. The devil made me do it. No no. Not those white devils I also said we had to fight against.

    Attorney: Ms. Sherrod. Did you say mr. Obama is one of those who need a history lesson & several other comments & requests directed at mr. Obama ?

    Sherrod: yes yes. The devil made me say it.

    Jack Cashill at American Thinker has a has a very good “more of the story”. Here it is for those who may have missed it. I hadn’t realized that part of the Sherrod settlement was used to purchase a radio station in order to…..promote minority farming?
