Judge acts while others debate Pentagon gay policy

WASHINGTON – A judge’s order for an immediate end to the military’s "don’t ask, don’t tell" policy forces the Obama administration to decide whether to keep pushing to delay doing what the president says is the right thing — allowing gays to serve openly in the military.

What a hero this judge is! And of course the Solons at the Associated Press could not be happier. They would like nothing more than to be ruled by unaccountable black robed mullahs, as long as they rule the way they want.

The court ruling is a boost for gay rights groups seeking swift change, who are disappointed that legislation President Barack Obama helped craft to end the policy is likely to languish in Congress until next year. Democrats are expected to have fewer seats and less power to override Republican objections after the Nov. 2 elections…

Well then, this power grab is completely justified. After all, those troglodyte Republicans might have some say after the elections.

Defense Secretary Robert Gates and Joint Chiefs of Staff Chairman Mike Mullen, the military’s top uniformed officer, also have supported lifting the ban on gays serving openly. But Gates and Mullen prefer to move slowly to avoid disrupting a military engaged in war.

Last we heard, we also had soldiers stationed in countries that seem to frown on open homosexuality. But don’t worry, this won’t help terrorists recruit new members. Not like keeping open Guantanamo has.

Meantime, despite a federal judge’s ruling in San Diego on Tuesday, the battle in the courts over gays in the military may be far from over

How is that possible? A judge has issued his pronouncement — a federal judge.

The Justice Department’s first response may well be another trip to the courtroom of U.S. District Judge Virginia Phillips in San Diego to seek a stay, or temporary freeze, of her ruling. If Phillips turns down the request, the Justice Department would likely turn to the federal appeals court in California.

Sure they will. They will be all over this like white on brown rice.

It was unclear whether Phillips’ injunction against the 17-year-old policy on gays in the military would affect any ongoing cases.

Speaking of ‘don’t ask, don’t tell,’ notice that we only hear who the judge was who issued this diktat after we get this far down in the article.

And the AP neglects to mention that Ms. Phillips is a President Clinton appointee. She is also a graduate of the University of California at Berkeley Law School.

But don’t worry, when Ms. Phillips courageously declared ‘Don’t Ask, Don’t Tell’ "un-Constitutional" last month, the New York Times found a friend of hers who declared that she is not an "ideologue."

So this can’t be judicial activism. Besides, the judge is a Democrat.

    The argument over Gays in the military will probably never end, but DADT is on its way out.
    I can see the argument for segregation or total integration in the barracks being the next step.
    If Gays are to bunk with straights, then Women can bunk with Men.

      Exactly, that is the obvious final solution, if we allow one person to sleep and shower and sh*t with another person who is sexually attractive we have to allow everyone to do everything with everybody and anybody.

      Total breakdown of privacy, wait aint privacy the basis of abortion? Guess the government will have to pay for abortions, secretly.

      Not if these men are truly patriotic. Gee, maybe it shouldn’t be punished unless someone actually tries to force himself on someone of the same sex?

      Maybe there is a problem with third-party outings?

      Yeah, what should their life style matter as long as they are patriotic.

      It doesn’t matter that homosexuals live statistically riskier lives, it is not like a soldier is a national asset.

      Our current military has almost no issues with sexual harassment now, that would surely only decrease if you add additional relationships.

      Nothing keeps “patriotic” gays from serving. Only orders that they not talk about it. If they are unwilling to follow orders like that what other orders would they reject?

      @David – the fear of being outed by a third party does keep them from serving – it happened earlier this year in South Dakota.

    Now that apparently every citizen of this country has a “right” to serve in the military then they better start putting in disabled access to barracks and bathrooms since now apparently the ADA applies to the military.

    Do not expect any increase of gay enlistees into the military. The rebellious proud to be gay & different crowd doing all the protesting of this issue are not patriotic to the military.

    They are committing a self-serving selfish act of hostility during the “most dangerous & critical time for our U.S. military fighting overseas.
    More soldiers & intelligence have been murdered under Obama’s closed eyes than even in the first dangerous days of the war began.

    This selfish group of the gay crowd cares more about sex than our military soldiers, whom are dying so they have the freedom, and won’t get their heads cut off like
    the muslim & middle-east terrorists do to their own sexual deviants.

    It’s not broken, so why the push to fix.

    Recruiters & military should start attending these gay protesters with booths “Enlist & Sign-up Here. We need You.” and see if any of these morons join.

      They don’t give a crap about the military. In fact, they hate the military.

      What they care about is venting their spleens on America for not loving homosexual perversions. Meanwhile, the other 99% of gays are delighted that they are now largely accepted by a large majority of Americans, as long as they restrict themselves to wearing their phallus hats in private.

      And of course, the subject has only come up because a tiny group of queers has been whipped into a frenzy about it by George Soros and the like, whose goal is to destroy the country, not protect it. The Soros led ‘community organizers’ who aren’t homosexual themselves hate homosexuals more than they hate conservatives. How do I know? Because they hate anybody who deviates in the slightest from their mirror image. You can tell that by spending 2 minutes on Daily Kos.

      Oh yes they do! That’s an offense in itself under the UCMJ (a gay forcing himself on anyone else in a sexual manner).

      I disagree – it’s broken if it allows for a third-party outing. The judge’s ruling should be appealed, but it should be upheld on appeal, and the Supreme Court should uphold it on appeal too.

      As for incidents with gays in the military increasing if DADT is thrown out one way or the other, I remind you that sex out of marriage is still a felony under the UCMJ.

      If that “Enlist and sign up here” sign were posted at such events, there’s your 24 percent right there.

      Oh, and Virginia Phillips is only echoing the sentiment of Vaughn Walker, who was a Reagan appointee and is a staunch Republican. Therefore, saying that she did it because she is a Democrat is incorrect; his ruling striking down the gay marriage ban in CA along with this one came out of the same court.

    If we DON’T give millions of $ to Pakistan for their flood relief, it will enable greater recruiting for terrorists!

    If people burn the Koran on 911 it will enable greater recruiting for terrorists!

    If we DON’T allow the Victory Mosque at ground zero it will enable greater recruiting for terrorists!

    Despite all the beheadings, floggings, imprisonment, stonings, hangings, of gay people in Muslim countries where are the alarmists now? Isn’t this a recruiting tool, and proof that America is the Great Satan?
