California Supreme Court upholds gay marriage ban

SAN FRANCISCO – The California Supreme Court has upheld a voter-approved ban on same-sex marriage, but it also decided that the estimated 18,000 gay couples who tied the knot before the law took effect will stay wed.

The decision Tuesday rejected an argument by gay rights activists that the ban revised the California constitution’s equal protection clause to such a dramatic degree that it first needed the Legislature’s approval.

The announcement of the decision caused outcry among a sea of demonstrators who had gathered in front of the San Francisco courthouse awaiting the ruling…

This is a bit of a (welcome) surprise.

Though the court is claiming to have decided the issue on very narrow grounds – legal terms.

But stay tuned for the riots and death threats.

    This was on Yahoo. Notice how when it benefits them their proposition rights are a good thing but when it goes against them it sucks.

    “In a sense, petitioners’ and the attorney general’s complaint is that it is just too easy to amend the California constitution through the initiative process. But it is not a proper function of this court to curtail that process; we are constitutionally bound to uphold it,” the ruling said.

    “It’s not about whether we get to stay married. Our fight is far from over,” said Jeannie Rizzo, 62, who was one of the lead plaintiffs along with her wife, Polly Cooper. “I have about 20 years left on this earth, and I’m going to continue to fight for equality every day.”

    Keep on protesting mister. You go girl, er, uh boy, uh, hell whatever you are.

      I agree, everything was done properly, and if the amendment was in their favor they’d be screaming to the heavens about how great it was. Of course it’ll never be settled, they’ll keep bickering back and forth until people either don’t care or it becomes meaningless.

    But even the queers don’t understand that the real reason for destroying the traditional family isn’t to spread homosexuality……the real reason is to undermine one of the primary social constructs that allows people to resist an all-powerful government.

    The queers are just useful idiots, like the femi-nazis, African Americans, Unions, educators, and virtually ever other looney group in the liberal fascist coalition.

      Im new to this site, but I already want to elect Proreason as president in 2012. ;) I agree, this isnt about “homophobia”, its about fighting to keep something sacred, and institution thats been around as long as man has (marriage). It disgusts me watching one thing after another get torn down in this country…. theyre fundamentally changing our society and getting away with it. Like tearing down a wall, brick by brick. When will the average American wake up and see whats going on? What will it take to get Americans to wake up??

    Sadly, I think proreason nailed it.
    It’s also about spitting on the Judeo-Christian heritage on which our Republic was founded, while the “Cool” Christians ever fearful of being mistaken as FredPhelpsians are used as useful idiots as well.

    Is this case just being set up to make it to the Supreme Ct. where the Sotomayor court will reverse it?

      Officially? Not so much. But the Catholic Church in China is flourishing – that is, the underground, faithful-to-Rome and not the state Church.

    I always have to wonder on whether the issue of homosexuality would be as main stream if they actually talked about what MAKES one a homosexual, be it anal sex or flossy the toothy queen.

    You know I think a kids book with a touch of reality is in order. Would anyone Object in the Liberal non-gay community?

    Proreason & JaneLovesJesus – hit it spot on – all this is about is to destroy the foundation pillars of America, in the end to destroy the country. What is left – a vacuum into which either anarchy (which I believe most of the foaming at the mouth liberals (which include the homosexuals)) want or tyranny which I believe The One ™ and his ilk desire.

    Neither one is acceptable in America – and one has to wonder – if the People’s Republic of Kalifornia can vote not once but twice on this issue and come down on the side of reality – and also vote not No but Hell No on the tax and spend agenda of the ‘representatives’ – One has to believe that there is hope for a change in America too.

    Maybe I’m missing something, but “only marriage between a man and a woman is valid or recognized in California” would seem to invalidate those gay marriages that existed. Sure, the law is not retroactive, so they can keep their old marriage license and frame it on the wall if they’d like, and talk about the year or so that they were legally married, but as of the day after the election, it’s invalid.

      Oh that’s it. The will of the people will not triumph over the law as it has been determined by the courts.

      I also think it’s interesting how suddenly these things are cherished, property rights and legal interests and all. Any other day of the year these principles would be meaningless in any court in California or most of the rest of the country.

    I noticed a couple of the authors that Obama listed as his favorites were gay. And as far as recent comments that Obama believes in marriage between a man and woman, did I miss that during a debate?? Obama is never clear. Oh, well his new Supreme Court Justice explains alot on the issue. He will always work things to blame on someone else.

    I am disappointed to see some of the ugly comments here that seem to reinforce the conservative stereotype of “homophobe.”

    What’s at issue here is that the California constitution allows the voters to put issues such as this on the ballot. The ballot initiative process is generally necessary to get things done in California that the legislature is too gutless to put into law or too revenue hungry to ever enforce fiscal responsibility.

    Prop 8 was on the ballot. It passed and gay marriages were banned. What happened, as almost always does when liberals lose, they runs to the courts, usually via the ACLU to overturn the legal will of the voters.

    The voters won this time. The courts upheld the election results. End of story.

    If the supporters want to change the law, put it back on the ballot for a straight up vote.

      And the issue when The Moron forced through a 790 Trillion “stimulus” package was just whether or not congress has the right to pass laws. They do. Case closed on that one too.

      Those of us concerned with the dimunation of the world’s millenium-old social compact, the one held sacred by religions all over the world, and the reason why civilization has been able to make men productive creatures instead of lust-crazed and violent sexual competitors……we just don’t see the little picture, do we?

      How many times do you allow a dead fish water? Will a room temperature mule pull a cart? Every time a election comes along will the perverts of Cal. force a vote on the people to allow their sense of perversion upon the unwilling?
      That being said ….. when the votes of the people are counted, will the very same votes have to be questioned by a select few?
