Suit Accuses Census Bureau of Hiring Bias

The U.S. Census Bureau was accused in a lawsuit filed Tuesday of systematically discriminating against minorities in its 2010 census hiring campaign.

In the suit, job applicants claimed the Census Bureau was unlawfully screening out minorities by requiring all applicants to provide court documents related to an arrest, whether or not it resulted in a conviction.

That requirement has illegally deterred many blacks, Hispanics and Native Americans from applying for jobs, according to the complaint, which said these groups are arrested and convicted at rates that "far exceed" those for whites.

It also claimed the Census Bureau improperly excluded job applicants who had been convicted of minor offenses

The Census Bureau didn’t return calls for comment. In an earlier interview regarding the bureau’s hiring plans, a spokeswoman said, "We will disqualify anyone with prior convictions or pending charges for certain categories, including murder, sex offenses, robbery, voter fraud, or other crimes that suggest a threat to safety or the integrity of census data."

“The safety of the Census data”? How about the safety of the people who are required by law to admit these people into their homes?

Applicants with criminal records, she added, won’t automatically be disqualified if they can "conclusively demonstrate that they do not present a current threat."

Oh well, that’s reassuring. But exactly who is going to make this assessment?

And will they be personally responsible for any harm done by the Census employee?

Samuel Miller, who represents the plaintiffs in the case, said: "The Census is improperly taking thousands of people out of eligibility for good jobs."

The suit was filed by New York law firm Outten & Golden LLP and seven public-interest organizations on behalf of two job applicants to the 2010 census. The complaint, filed in U.S. District Court in New York City, seeks class-action status.

Evelyn Houser, an African-American plaintiff, said in an interview that she was denied employment by the Census Bureau after she failed to produce court records of a 30-year-old arrest for theft, and that her record was clean since then. According to the complaint, the Census Bureau had learned of her arrest but still wanted independent documentation. Ms. Houser responded by providing the agency with fingerprints but no court documents

Just imagine the barrage of class action lawsuits that would be brought if, after a string of Census workers crimes, it was discovered that the Census Bureau had done nothing to discourage the hiring of people with criminal records.

After all, how would you like to have to admit a convicted sex offender into your house?

That there could even be a question about hiring criminals, is preposterous. And just one more indication of how far we have skipped down the road to perdition.

But we can’t do anything — no matter how common sensible — that can possibly be called "racist" by even the most preposterous race-hustler.

Racism is the ‘Mother Of All Crimes.’ Everything else pales by comparison.

    mrs proreason and I were just saying last night…..”gee, we sure hope our census worker is an ex-con. They really need a hand, and wouldn’t it just be great if we were able to help one out. Imagine how good we will feel by possibly reducing the recidivism rate from 95% to 94.9999999%. And if he uses the opportunity to case our house, and comes back in a few months or a year to steal us blind…..well…..we will always have the satisfaction of knowing we did our patriotic duty….assuming, of course, that he doesn’t kill us.”

      This is exactly why…with my husband’s firm approval…we answered only how many people live in our house. I scrawled “I have a right not to answer this question” across all other questions.

      They keep saying on their tv ads that they must know how many people live in an area. Well…they have that. Nothing else is their business!

      We know full well we may get flack from them…but I expect others are doing the same thing out of protest for all the invasive questioning especially in the long questionnaire.

      I DON”T RECOMEND anyone else doing this. But we did.

      At the rate that this government flubs up…who knows who is looking at (and possibly selling) our information.

      BTW…I got TWO census forms. I’ve heard others are getting multiple forms…one person claimed to get four!

      Looking forward to the health care debacle…NOT.

      Jobeth – You are not alone – I was kind of upset when I saw what my hubby ‘answered’ on the census – But we did answer #1 (how many) & #9 (Other, American), as I worked for the Census (actually then it was the Dept of Commerce (last one in 1998 – ground work, mapping).

      I had read (stuck in some waiting room, reading (gag)Time(gag)) – from the head of the Census – that American & Human are 1) used quite often, even in previous Census and 2) legal answers.

      I also am beginning to read elsewhere on the Web that many Americans find some of the new questions – umm, gee how to say this – offensive, invasive and not Constitutionally required. And I find it ironic that some of the ads these morons are running cite the enumerating aspect of the Census – thus giving fuel to our fire of not needing the info the other questions ask.

      You Are Not Alone.

      last syllable of the first name ending with j-o-n. Pronounced
      John, right? Nope. Pronounced Juan. This is way too typical.

      Some will think this is creative. (texting) The sad fact is the kid
      will be saddled with pronunciation questions for life, as well as
      most people thinking the parent was a dope or on dope. Yep,

    Stop the presses. We must not discriminate. Only people with zombie white skin can be prosecuted under the law.

    To call a criminal background check discrimination is a joke. What, does the government EXPECT minorities to fail now?

      You probably know this, but Ann Coulter says that if you remove households led by single mothers, the crime rate is the same for blacks as for whites.

      That immediately makes you wonder why ALL liberal policies promote households led by single mothers:
      – welfare
      – abortions
      – ObamyCare
      – pay to procreate
      – infinite excuses for men not to work
      – anti marriage
      – anti religion
      – equal pay for unequal work
      – lenient sentences for criminals
      – redistribution
      – and many more

      It’s like they sat down and brainstormed how to create a criminal sub-culture.

      Revolving door confinement

      More welfare, food stamps and medicaid for the next generation

      Your point is spot on!

      The next generation gets lost in all this and perpetuates the “gimme” attitude…and becomes the sitting ducks for the lib takeover because they have do idea or inclination to do it for themselves.

      Truly sad. Kids need moms and dads. And hands on nurturing from both. And my personal opinion…moms should never work outside the home while her children are in their pre-school, formative years.

      If you don’t want to dedicate that time then don’t have children. It takes a mom and dad…not a village to raise a child.

    The disproportionate number of minorities in jail is one of the few times the liberal mind doesn’t jump immediately to casue and effect thinking. Kind of like the fact that a similar disparity exists in homosexual pedophilia to heterosexual pedophilia. maybe I am focusing on the wrong part of the story.

    You do not have to let them in your house or open the door. You should have mailed it in, or called the number and do it on phone. I just filled the first gray box. And added a little to appease them. As to sex & adult/children After that there was alot of please’s, and the have no business getting birthdates, or phone numbers.
    Last ten years ago, after mailing end homeless looking guy came to door. did my usual open window. Turns out they really lost my census. I told him to leave a copy on the porch and I would redo it and mail it in. He then proceeded to kick my door and bang on the window and I told him I’d call police. I then called the 800 number who said they did not recieve it, and that we could do it on phone, so unusually she only asked the only few questions they really only have the right to. My form ten years ago, wanted to know how many bathrooms, and year of car I drove.
    This was under Clinton.
    If you refuse to do the census, I heard the penality this year was 100 dollars, though no penality was written. Ten years ago it was 350 dollars I think.
    We can thank Acorn for the extra percautions. This years doesn’t even make since. It says in the first grey box, do not to count anyone gone in military, in college, temp staying, but then goes on and wants all their information anyways. I’m not sure the difference between Mexican origin or Mexican race either, not that it matters.
    Also, the world is worse than ten yeas ago, and Identity theft up. Considering the excellent job Mexicans are doing in making accurate
    ID’s, what stops anyone from making ID’s hanging around their neck.
    Pepper spray doesn’t always deter a predator I learned. So, if lawful where you live have a gun near by might be a good idea for those in rough crime areas. The other person outside your door may be going through drug withdraws & prepared to hit you over the head, even if they are truly census hired. Be prepared. Especially now that the 15th is up.
    I heard some people in Milwakee did not get their forms in the mail. I suggested they call the 800 number and do it on phone, or be on guard someone will likely come to their home.

    Arrested for any reason? Come on! I hate to admit it, but the census people are dead wrong on this one. An event 30 years ago? How long do you have to pay for a crime?

    You were arrested for protesting, disorderly conduct, or fighting at a bar in college, and they want documentation on that? Really? Whether it resulted in a conviction or not? So if you were innocent, but you were arrested, the census considers that the same as guilty….

    You can never REALLY pay your debt and live it down, because someone will always ask you about it for the rest of your life. –even minor stuff.

    We DO live in a police state. ..

      The census denied the accusations in an earlier statement, refusing those actually convicted of crimes & of nature that they consider putting them potential liable situations. Plus the plaintiff speaking for herself may not be telling the truth. Time will tell.

      Even if this woman’s claim is true (I doubt it), I really doubt that it’s anything but an isolated incident. The ambulance chasers specialize at making such things seem as if they’re SOP for their targets.

    Had drinks with a friend who works for the Census last night. He said he never understood conservatives’ complaints about gov’t employees until he became one. He also said he makes $160 a day for doing literally nothing. There are five paid breaks every day; employees get paid for hours they don’t even work. He went home several times in the course of the workday and received no reprimand; he was even promoted to supervisor. Everyone at that office, he explained, is trying to draw out their employment for as long as possible by doing as little as possible. All of this is absolutely true and came from the mouth of a self-proclaimed socialist. Nice work if you can get it!
