Congress governs self under ‘Obamacare’

WASHINGTON (AP) — … Members of Congress are governing themselves under President Barack Obama’s signature law, which means they have great leeway in how to apply it to their own staffs.

No, it means that the Democrats in Congress are once again flouting the very clear and explicit ‘Law Of The Land.’ Where is the outrage?

For House members and senators, it’s about a section of the law that may — or may not — require lawmakers to toss some staffers off of their federal health insurance and into the Affordable Care Act’s exchanges. The verdict from congressional officers is ultimately that lawmakers, as employers, have discretion over who among their staffs gets ejected, and who stays. And they don’t have to say who, how many or why…

[T]he law as written is open to broad interpretation, inspiring a bureaucratic web of memos, regulations and guidance that members of Congress say allows them to proceed on the question of staffers and coverage as they see fit…

The Affordable Care Act, signed into law in 2010, only requires members of Congress and their "official" staff members to get health insurance through one of the law’s marketplaces, or exchanges.

This is a lie. The Grassley provision states: "Enrollment by Members of Congress and Congressional Employees — Notwithstanding any other provision of law, beginning July 1, 2013, Members of Congress and congressional employees would be required to use their employer contribution (adjusted for age rating) to purchase coverage through a state-based exchange, rather than using the traditional Federal Employees Health Benefits Plan (FEHBP)."

The language (and intent) is as plain as day. There is no mention of "official office" versus "official staff." In fact, there is no mention of the word staff because it covers all "Congressional employees."

Guidance memos from the Senate’s financial clerk and the House’s chief administrative officer, obtained by The Associated Press, define "official" aides as those who work in the lawmakers’ personal offices. Committee and leadership aides, then, would be exempt and could stay on the federal health insurance program…

So all of this ‘confusion’ is based on "guidance memos" from a Democrat hireling in the Senate. And not on the ‘Law Of The Land.’ And the AP is just trying to confuse the issue in order to pretend that the Democrats are just following the law. They are that shameless. That beholding to their bosses.

House Speaker John Boehner and all four Senate Republican leaders are among them, putting their entire staffs into the exchanges created by a law they loathe. That allows them to slam Democrats, the new health care law’s chief defenders, who are keeping leadership and committee aides on the federal health insurance program…

How venal of them. To slam the Democrats for clearly evading the ‘Law Of The Land.’ A law they crammed down the throats of everyone else.

  1. All we need to do is get our senators to send us a form letter stating that we all are officially unpaid congressional staffers in charge of constituent research. I mean as readers and commenters on this site, we are all doing daily political research right? Sounds like my kind of loophole. Written for political criminals, but used by we the people for the same end. Freedom from government life management.

    While congressmen may hire and fire their staff, the US government employs their staff members. To give a different analogy, Bob may be the local manager at Walmart, and be able to hire and fire, but the employees are paid by Walmart, not Bob, and are therefore Walmart’s employees and Bob’s subordinates.

    Unless a congressman is paying a staff member out of their own funds; said staff member is an employee of the US government, specifically of Congress and therefore subject to Obamacare.

    You idiots forced this legislation down our throats. We will make sure you are stuck with it too.

    • The only way WE will be able to force these people to live under the laws they support, write and have their bosses pass is at the point of a gun. Other than that, we have no power, not even at the ballot box.
