Pentagon tells recruiters: You must accept gays

WASHINGTON (Reuters) – The Pentagon said on Tuesday it had told U.S. military recruiters to allow gays and lesbians to apply for service, as gay veterans tested a court order striking down the military’s ban on openly serving homosexuals.

California-based U.S. District Judge Virginia Phillips ordered the military a week ago to stop enforcing the "Don’t Ask, Don’t Tell" policy and on Monday tentatively refused a Pentagon request to re-instate the 17-year-old ban

So our military has to change its policies depending on the latest fatwa from a single District Court judge? When has that ever happened so quickly before?

Needless to say, this change has been immediately implemented because Mr. Obama agrees with this Clinton-appointed mullah, no matter how much he pretends otherwise. 

By the way, ‘Don’t Ask, Don’t Tell’ has been previously upheld at least five times in federal courts. But Ms. Phillips’ latest ruling trumps all.

What timing. And what a coincidence that the news media were there to report this historic event.  

The Obama administration is waging a legal battle to temporarily reinstate the Clinton-era policy, whereby homosexuals are allowed to serve in secret but are discharged if their sexual orientation is revealed…

Yes, the Obama administration is fighting for DADT ‘tooth and nail.’

But speaking of fatwas, lest we forget ‘DADT’ was merely a Clinton ‘directive.’ That is to say, it was never legislated by Congress.

In fact, Congress had passed exactly the opposite legislation (a pdf file), which sought to preserve the proscription on homosexuals serving in the military. The Clinton ‘directive’ overruled the will of the people’s representatives.

"Recruiters have been given guidance, and they will process applications for applicants who admit they are openly gay or lesbian," said Cynthia Smith, a Pentagon spokeswoman

Isn’t it amazing how quickly the government can act — when it wants to?

But when judges rule that government bans on offshore drilling are actually illegal, they aren’t quite so responsive.

    I guess this means a single District Court judge can now declare war illegal and order the DoD to shut down operations.

      The ruling is being appealed…but the judge isn’t staying her decision. It would have to be reversed by the Ninth Circuit, and then it could face a review by the Supreme Court in the 2011-2012 term.

      Highly unlikely – and the real issue with DADT has been outings of gay soldiers by third parties…not by themselves.

      Adam Moreira. You are wrong. It is gays that let the hat out of box, and the military doesn’t give a hoot,. They have to become overbearing about being gay, or such activitie displayed that it’s misconduct.

    My understanding is that DADT was a workaround for the military code which rejects homosexuals altogether from serving at all. So if DADT is no longer valid, then isn’t the fallback position that gays can no longer serve at all? How does DADT being tossed out also undo the existing military code? Am I missing something?

    You’re exactly right, untrainable, from what I understand about the law.

    Speaking from the Marine side of things, the recruiters can bring up to MEPS whomever they wish, but it’s the guys up there who make the final decisions. They can find a way to disqualify a-n-y-o-n-e. Even with pressure from the CO to push people through, the MEPS liaisons can hold their ground by saying, “Okay, Major So-and-so, I just need you to sign off on this.” And the Major won’t. They do not stick their necks out for recruits. So, here’s hoping and praying that our guys at MEPS hold their ground – knowing they have the Commandant on their side.

    I’m not sure what you mean, Adam. The CinC is Obama. Force them out? Unwritten retaliation?
    Obama doesn’t write their FitReps. And nearly every policy of his right now is written retaliation against Marines, and they’re still doing just fine. I don’t think you understand much about the Marine Corps.
    Speaking of which, the boss says I’m off, too. Those were the old days. It won’t be quite so simple for the MEPS guys on this. Recruiters will be under a lot of scrutiny – no doubt there will be under cover people trying to trap them, and MEPS will probably be under increased watch, too. Plus, civilians are involved on the MEPS side, which is a big variable. I do wonder how many gays actually want to join so badly right now. One good thing is that the recruiting needs are low right now – many who qualify and want active duty are having to go reserve.
    I’m still praying that those in positions to stand in the way of this mess will do so.

    Too damn bad the military can’t go on strike – if ever – and believe me since 1975 I’ve seen a lot that made us seriously reconsider a career – there was a reason to strike – this is it.

    I’m sorry people, gays have been part of the military for a long time – most especially amongst the women – if they get too uppity – they are taught their place. It has only been in the past decade or two that this has become a demand to serve ‘openly’ – which is just another place and way to shove the beliefs of a minority down the throats of the majority – and in this case – against all good common sense.

    I had a friend that the entire time she was on active duty (well, ok until the end when she met her husband to be) she went ‘out’ with the gay guys in her unit. It provided her a male to allow her the freedom to enjoy the clubbing without all the hassles and gave the gay guys cred that indeed they weren’t ‘gay’. A win-win.

    This stupidity is just a lose-lose.
