FBI’s James Rosen Accusation Is Unprecedented

Fox calls DOJ investigation of reporter “downright chilling”

Fox News reacted with outrage Monday to the revelation that the Justice Department tried to criminalize the newsgathering activities of reporter James Rosen in 2009 “for simply doing his job.”

“It is downright chilling,” Michael Clemente, executive vice president for news, said in a statement. “We will unequivocally defend his right to operate as a member of what up until now has always been a free press.” …

Federal investigators seeking Rosen’s personal e-mail suggested in a 2010 search warrant that he was potentially criminally liable for soliciting the disclosure of classified information. The warrant was unsealed in 2011, but a Fox executive confirmed that the network was not aware of the allegations until Reading the Post’s report Monday.

No reporter, including Rosen, has ever been prosecuted for soliciting such information. But media lawyers and government transparency experts said that the Justice Department’s characterization of Rosen as a possible co-conspirator had crossed a line.

“Asking for information has never been deemed a crime,” said Steven Aftergood, the director of the Project on Government Secrecy at the [radical left] Federation of American Scientists. “It’s a line that has not been crossed up until now.”

The New Yorker has posted the full forty-four-page Justice Department application for the search warrant of Rosen’s Gmail account.

[T]he Obama Justice Department not only subpoenaed Rosen’s private e-mails but also said that Rosen was “an aider and abettor and/or co-conspirator” in the alleged crime.

Rosen was not charged with any crime, but it is unprecedented for the government, in an official court document, to accuse a reporter of breaking the law for conducting the routine business of reporting on government secrets.

And yet there is still only the mildest outrage about this coming from our news media.

    The targeting of ordinary Americans, of the common man, of apolitical, private citizens by this Administration is the essence of tyranny.

    The IRS targeting of Tea Party groups, Romney donors, conservative organizations, Billy Graham, and Dr Anne Hendershott. The DOJ and FBI assaults on James Rosen, Fox News, and freedom of the press. The State Department and DOJ attacks on whistleblowers. The DOJ threatening its own Immigration Judges. The deployment of the FBI and BATF against innocent people. The investigation and demonization of Joe the Plumber, Rick Santelli, AIG executives, bankers, Carrie Prejean, Sgt. Jim Crowley and the Cambridge police force, Chrysler bondholders, hedge fund managers, citizens and resident aliens with foreign bank accounts, Napolitano’s “terrorists” (veterans, Dr Ron Paul supporters, pro-lifers, etc.), of the bitter clingers, of those who live by their own work, of the wealthy, of Christians, Tea Party participants and attendees at town hall meetings such as Katy Abram. Legislating with a sledge hammer. Voting to pass bills that they haven’t even read. Voting to pass bills that nobody has read. Voting to pass bills that they haven’t even written yet. The arrogance, the thinly veiled threats, the Bolshevik-style thuggery, the my-way-or-the-highway attitude, the shut-up-or-I’ll-kill-your-dog message, the no-opposition-will-be-tolerated and in-your-face conqueror aspect of this Administration has to be seen as something entirely novel in the American experience.

    A line has been crossed.

      I think a lot of us are thinking of the same solution. The fact that I’m leery of even stating that solution here speaks of the tyranny that we are feeling.

      The time for decision is rapidly approaching.

      Fear is our enemy!
