Cruz: Democrats want to pack court with judges to protect ObamaCare

Sen. Ted Cruz (R-Texas), the Senate’s leading critic of the Affordable Care Act, denounced a vote Thursday to prohibit filibusters against appellate court nominees as a scheme to save the health law.

“The heart of this action is directed at packing the D.C. Circuit because that is the court that will review the lawless behavior of the Obama administration implementing ObamaCare,” he said.

“President Obama and the administration refuse to follow the plain text of the law, and the D.C. Circuit is the court of appeals that has been holding the administration accountable."

Cruz said the rule change, which passed Thursday with 50 Democratic votes, “was designed to pack that court with judges that they believe will be a rubber stamp.”

As usual, The Hill only gets it half right. Senator Cruz is saying the filibuster change will make the DC Court of Appeals a rubber stamp for all of Obama’s agenda, not just Obama-Care. After all, the DC Circuit Court of Appeals is the nation’s second most-powerful court. It has jurisdiction over all government regulatory matters. It also handles most of the lawsuits against Obama-Care, or the EPA or any government program or agency.

The filibuster rule change will now allow Obama to add three judges to the DC court, where there are currently four judges from each party on the Appeals Court. Which will make it a rubber stamp and a joke. — Which is exactly what dictators like Hugo Chavez do.

So this change of the filibuster rules goes far beyond Obama-Care. This rule change will help Obama rule as a dictator for the rest of his second term. None of his new regulations will be able to be challenged via the courts.

The vote to pass the rules change was 52-48, with the two independents, Sens. Angus King (Maine) and Bernie sanders (Vt.), voting with the Democrats and three Democrats voting against the change.

So the opposition was actually bi-partisan.

The addition of three Democratic-appointed judges to the 11-seat court will shift its ideological balance, which had been tilted to the right. This could have significant implications for the new healthcare law because the court has primary jurisdiction over many federal regulatory matters…

In fact, practically all regulatory matters.

Other Republican senators also expressed concern that a Democratic bias on the court will make it harder to halt the implementation of ObamaCare. Sen. John Barrasso (Wyo.), the chairman of the Senate Republican Policy Committee, said the next stage of battling the law’s implementation will take place in the D.C. Circuit.

“Lawsuits affecting the healthcare law will go through this court, and if the president is able to pack this courts, it’s his effort to try to defend a law the American people don’t like and believe they can’t afford,” he said…

That is true. But this goes far beyond Obama-Care. This rule change will help Obama rule as a dictator for the rest of his second term. None of this regulations will be challenged via the courts.

The change could help Obama implement the law in other ways. It has immediately improved the chances of confirming nominees to the Independent Payment Advisory Board. The 15-member panel, one of the most controversial facets of the law, has responsibility for curbing the cost of Medicare. The administration had little hope for setting up the board before Thursday’s rule change.

This is the ‘death panel’ that everyone said would never exist.

The change will also give Obama more flexibility in deciding whether to replace Secretary of Health and Human Services Kathleen Sebelius, who has received a large portion of blame for the law’s botched rollout…

Like that would ever happen. But this rule change does mean that Obama will be able to appoint the most outrageous people to help him advance his agenda. The Senate will no longer ‘advise and consent’ on appointments. They will only consent.

    So now we will be left with a court who will determine whether or not an act committed by the man who appointed them is constitutional. So much for checks and balances.

      Speaking of Chavez, Antonio Banderas (the actor that came to America and made a fortune and married a fluzy) was in some ethnic (spanish/latino) country critical of Obama for not running the country big businesses like Hugo Chavez. So, I’m all for capping liberal actors and actresses income at $1 million dollars a year. May the fake imposter of Torro catch his cape on fire.
