Franken campaign asks for certificate to take seat

ST. PAUL, Minn. – Democrat Al Franken is asking the Minnesota governor and secretary of state to issue an election certificate that would let him take office in the Senate.

In letters the campaign sent Monday, Franken’s lawyers argue that a seven-day waiting period has passed and he should get the signed certificate. State law requires the waiting period after the election is finalized; the election was finalized on Jan. 5, with Franken leading Republican Norm Coleman by 225 votes after a statewide recount.

But Coleman is suing over the result. Minnesota law appears to prevent the issuance of a certificate until that case is resolved. Franken attorney Marc Elias says the campaign believes federal law entitles him to the certificate before the Coleman lawsuit is settled.

There was no word from Republican Gov. Tim Pawlenty and Democratic Secretary of State Mark Ritchie.

Officials turn down Franken request in Minn. race

ST. PAUL, Minn. – Democrat Al Franken was quickly turned down Monday when he asked Minnesota’s governor and secretary of state to issue an election certificate that would let him take office in the Senate.

In letters the campaign sent to Republican Gov. Tim Pawlenty and Democratic Secretary of State Mark Ritchie, Franken’s lawyers argued that a seven-day waiting period for issuing the certificate after an election has passed and he should get the signed certificate. But the state officials said their hands were tied by state law and they could not act…

Minnesota law prevents officials from issuing an election certificate until legal matters are resolved. But Franken’s legal team argues that federal election law entitles Franken to receive the certificate before the lawsuit is settled…

In a statement, Ritchie said state law requires him and the governor to turn down Franken’s request.

"Minnesota law is very clear on when a certificate of election can be issued. Neither the governor nor I may sign a certificate of election in the U.S. Senate race until all election contests have reached a final determination," Ritchie’s statement read…

Pawlenty echoed Ritchie, saying it is clear the law won’t allow him to issue a certificate while the race is being contested in court…

Franken’s campaign was due to file a response to Coleman’s lawsuit later Monday. Elias characterized the Coleman action as "riddled with errors that are fatal to much if not all of the claims made in the petition."

By law, a trial on the lawsuit must start within three weeks of its filing, which occurred last Tuesday. It will be heard by a three-judge panel that has not yet been named.

A little good news.

Of course it is only a question of time before we have Senator Franken.

    I have one question – since on the morning after the election – Norm Coleman had won by 725 votes – and now Franken is claiming to have won by 225 votes – where in the he!! did a failure like Franken come up with 950 votes?!? And (ok two questions) how can anyone with a brain – verify or even believe this bs?

    Sadly I agree that this clown will be seated as this is the Year of Stolen Elections (which is why I guess that the Left blathered on for so damn long about ‘selected not elected’) so that the stupid masses would believe that every election is stolen in some way. It’s been their setup and intention to steal as many elections and stack the State, Senate, House and of course the White House with their minions to destroy America from within.

    What fun the next 4 years are going to be.

      Because they weren’t REAL votes. Only phony ballots that came up AFTER election day! Hope this helps your understanding. ;-)

    A vote that was written “Frankenstein” was counted as a vote for Franken. We know he is a monster, but even this is too far. Norm Coleman won and the canvassing board is lying and cheating to give it to Franken. Disgusting!

      Excellent idea – I started doing that when Cameron “if you vote for Bush, you vote to legalize rape” Diaz started saying moronic things, I will add Clooney, Damon, Fox (alhough he hasn’t done anything of note in a long time) and several others to my growing list of hollywood elite that I will no longer support with my hard earned money.

    Yes Al has had a miracle occur, the canvassing could only see the name Franken.
    And yes Alice – Boycott all the dopey liberal stars. Anne Hathaway, Michael J. Fox, George Clooney, Ted Danson and the rest that feel they need to push their opinions down our throats. They complain about the Religous Right pushing their views on people but can’t see what they themselves are doing.

    And we’re surprised by this turn of events? Of course Franken used recounts to his advantage. He learned the technique from the other Al,… Al Gore. Not to mention that Franken’s been known to visit republican conventions during election years to see or spy on how the GOP does things and to spot any weaknesses he sees to use in his party’s favor.

    They were talking about the recount on the radio and were saying there were votes for Coleman bubbled in then had an X marked through them. Now mind you Franken’s name was not bubled in but because there was an X through the Coleman bubble these geniuses decided that the people did not want to vote for Coleman and gave the vote to Franken. I would say that the people REALLY REALLY wanted to vote for Coleman but that’s just me.

    As to these celebutards I believe that they are liberals because they are ashamed of their fame, They know that there are thousands, maybe millions of people that can do what they do and feel that they have to punish the rest of us for their shortcomings. Clooneys good but he ain’t that good. He’d probably be driving a taxi somewhere and doing weekend theater if mamma wasn’t Rosemary. Most of these idiots were just in the right place at the right time or maybe they just happened to fit the costume.

      VMAN, I’ve been following the Franken election-stealing story, but every day there’s a new revelation. It just seemed obvious that they were cheating; how else could ALL of the “discovered” votes be for Franken?

      And for the sake of accuracy, George is Rosemary Clooney’s nephew, not her son.
