Federal Workers Union Sues White House Over Possible Government Shutdown

With time running out for congressional leaders to reach a budget deal, the country’s biggest federal workers union is taking the Obama administration to court for what it called a failure to explain how federal programs and services would be affected if there’s a government shutdown.

The American Federation of Government Employees announced Tuesday that it filed a lawsuit in federal court last week seeking details on the shutdown plans of federal agencies.

The union’s national president, John Gage, said he filed the lawsuit after the White House Office of Management and Budget failed to respond to a Freedom of Information Act request sent early last month.

Gage said public unions have been given very little information on how agencies would determine which employees are essential in the event of a government shutdown.

If there is any doubt if you are essential, then the odds are you aren’t. How many federal workers are needed on MLK, Jr’s Birthday, Presidents Day, and Veterans Day? Whatever that number is, that is the most we need.

"It’s not something that should be cavalierly handled," Gage said in a written statement. "If a shutdown goes on, there will be federal employees who are going to be hurt financially. They should know before the eve of a shutdown what is happening and it should be done orderly and not in a last-minute rush."

As we and even the AP have noted, there have been numerous government shutdowns. And not a single federal employee has ever lost a dime. Indeed, only 1 in four federal workers even stays home. And they have always been paid for their vacations.

So Mr. Gage is shedding crocodile tears about his precious charges being put at risk. In the worst case scenario, some ‘unessential’ bureaucrats will get some more days off with pay. Boo hoo.

The Office of Management and Budget declined to comment on the lawsuit, saying it doesn’t talk about pending litigation. But the office said the administration "has taken unprecedented steps to improve government transparency and accountability, and shutdown planning is no exception. We still believe that there is an opportunity to avoid a costly government shutdown, which would cause undue harm to the lives of federal employees, the services millions of Americans rely on, and the economic recovery under way."

The Office of Management and Budget are boldfaced liars. A government shutdown will not be "costly," nor will it "harm" any federal employees unduly. And it certainly won’t hurt our wonderful "economic recovery." If anything, it will give businesses a day off from overbearing government regulations.

The agency called plans for a shutdown "pre-decisional at this time," adding that more information will be released as it is finalized…

Yes, how could we survive as a nation without talk like "pre-decisional."

Gage said he sent a letter to Attorney General Eric Holder last week, stating the union’s position that requiring federal employees to work without getting paid violates the 13th Amendment, which prohibits involuntary servitude.

Excellent. Fire them instead.

Gage said if there is a shutdown, the union will be calling on employees to report to their job sites early next week to demonstrate that they are ready to go back to work.

"The American public can see at least that federal employees know the importance of their jobs and that political games should not be played with their services or with their jobs," he said.

Mr. Gage and the government unions are scared spitless that the American public is going to discover that they can get along quite well with the government shutdown. Indeed, the government has shutdown numerous times, apart from the famous 1995 shutdown, and nobody noticed.

In fact, the biggest problem will probably be waking up the government workers, to tell them to go home.

    I still want to know if That Which Must Be Repealed is going to be implemented during a ‘shutdown.’ It’d be such a shame if our noble sprint to socialized health care were delayed, especially with a SCOTUS ruling coming ever closer.

    The only thing that is costly about the government is when it is running at full speed. That is the textbook definition of costly.

    I never heard of the AFGE but don’t think they have a legal leg to stand on. I don’t think you can sue before something happens. Not sure how the unions work, but think they would have to file labor charges as a union, and either way when you don’t get records which is soooo common. I think the federal employee has to first appeal to the Office of General Counsel, and I think private people do to before they can sue.

    Does not sound like they recieved letters ordering them to work without pay, so they are putting the horse before the cart.

      I think by the caliber of letters wrote on their own stationary, going to the news is a publicity stunt of making them look powerful, and fearmongering to get federal employees to join their union $.

      They don’t have the liberal fad symbol of emblems we see at the top of pages with the stick people with round heads to represent the globe with waves of arms and legs. The tops of their global heads are cut across look like jar head crew cuts. Real macho. No female hair-do? Oh I get it butch.
