Man Is Convicted in Newark Schoolyard Murders

NEWARK — In the first trial stemming from the shootings of four college-age friends in a Newark schoolyard nearly three years ago, a jury on Monday returned guilty verdicts for three murders and one attempted murder after less than a day of deliberations.

The jury in State Superior Court here convicted Rodolfo Godinez, a 26-year-old gang member and native of Nicaragua, of all the charges facing him, including multiple counts of robbery, weapons charges and conspiracy.

You will look for vain in this article to see the New York Times call this miscreant an illegal alien, or even mention that he was in this country illegally.

Each murder count carries a minimum penalty of 30 years to life in prison, and the sentences can be given consecutively…

Mr. Godinez showed no emotion as the verdict was read, staring impassively straight ahead, his hands clasped in front of him, not turning to look at the jury. Judge Michael Ravin scheduled sentencing for July 8.

Mr. Godinez’s lawyer, Roy Greenman, said, “Obviously, there will be an appeal on a number of grounds,” but he declined to elaborate

Prosecutors did not assert that Mr. Godinez, one of six defendants in the case, was the attacker who hacked at some of the victims with a machete, or the one who shot each of them, execution-style, in the back of the head with a .357-caliber Colt Trooper revolver. But they described him as an active participant in the attack, and a member and recruiter for the violent street gang the attackers belonged to.

The emotional high point of the trial came when the surviving victim, Natasha Aeriel, took the witness stand to describe the night of Aug. 4, 2007, when she, her brother Terrance Aeriel, Ms. Hightower and Mr. Harvey gathered behind the Mount Vernon elementary school to chat and listen to music. Ms. Aeriel recounted being sexually molested and slashed with a machete, hearing the shots that killed her brother and friends, and then being shot, herself.

But just as important was the tape-recorded statement that Mr. Godinez — who did not testify — made to the police the night he was arrested, which was played for the jury. On the tape, he described the other defendants, including a half-brother, Alexander Alfaro, as “my homeboys”; admitted collecting the victims’ valuables when they were robbed; and acknowledged that after the shootings, he and the others ran to his house a few blocks away, then drove away together.

Mr. Godinez also described his involvement in MS-13, or Mara Salvatrucha, a gang that originated among Central American immigrants in Los Angeles. He suggested that the schoolyard killings were a long-planned revenge for another attack — an idea that lawyers on both sides of the case discounted — and that they involved one of the attackers proving himself to the gang…

Ms. Hightower, 20, her boyfriend, Mr. Harvey, 20, and Mr. Aeriel, 18, were lined up against a wall and shot, and Ms. Hightower was badly wounded with the machete before she died. Ms. Aeriel, then 19 — who was Ms. Hightower’s best friend — was left with partial facial paralysis, difficulty using her jaw, deafness in one ear and chronic pain, despite multiple reconstructive surgeries

The crimes spurred changes in city policing strategies, including the greater use of video cameras and devices to detect the sound of gunshots.

Yes, that’s what we need.

More video cameras. More devices to detect the sound of gunshots.

    Me thinks he too, laughed when read his charges.

    Sounds just like our government. Their solution to a crisis is:

    1. Faster ambulances.
    2. More efficient chalk for body outlines.
    3. More regulation.
    4. Laws with a victim’s name in it that will do nothing.
    5. Screw over law-abiding citizens with some ridiculous law.
    6. Increase fines, make misdemeanors felonies, increase jail time—-which makes criminals want to die in a hail of gunfire rather than go through all that B.S.
    7. Give police fascist powers to kick citizens around.

    Easiest solution:
    -Allow regular people to carry concealed weapons.
    -Secure the border.
    -Social Security number registry to be accessed for renting, school, credit cards, voting, driver’s license, hospital visits, employment etc. (we know who wins the PowerBall by the end of the commercial break, but can’t figure out who wins an election, or who is an American citizen-D’oh!)

    I’ve always been in favor of what I call the Eye for an eye, type of punishments for criminals. I think that they ought to hack on this scumbag with a machete for awhile before they shoot him so he can know the type of pain he inflicted.
