Rep. Jackson Lee introduces bill to cut funds to stand-your-ground states

Rep. Sheila Jackson Lee reintroduced the Justice Exists for Us All Act to Congress Wednesday.

What a catchy title. And it is just as accurate as the "Affordable Care Act" (Obama-Care). And the "American Recovery And Re-Investment Act" (aka the first Stimulus).

The bill, which the Texas Democrat stated is a response to the acquittal of George Zimmerman in the shooting death of Trayvon Martin, would pressure states to drop stand-your-ground laws, which assert that citizens can use force for self-defense rather than being required to retreat from dangerous situations.

Under the Justice Exists proposal, states that didn’t amend their stand-your-ground laws and require a “duty to retreat” would face a 20 percent cut to previously allocated funds.

As we have previously noted, the concept of stand your ground is not new. It is as old as the right to self defense itself. But what is new, and very radical, is the so-called "duty to retreat." Which is a very recent invention of the radical left.

But Ms. Jackson Lee is trying to force it onto the states via federal blackmail.

Additionally, to avoid the cut in funds, states would have to require local neighborhood watch programs to register with local law enforcement.

Why do Democrats hate the idea of self defense so much? Why are they always on the side of the criminals?

Jackson Lee’s press secretary Mike McQuerry reiterated to The Daily Caller that Congresswoman Lee is pushing the bill now because “she’s always been interested in what happened with Trayvon.”

However, Zimmerman waived his right to a defense under Florida’s stand-your-ground law. When TheDC pointed this out, McQuerry said merely, ”She just thinks it’s the right time to pursue it now.” …

Note that Ms. Jackson Lee says she is doing this in response to the Trayvon case. (And never mind that it was not used in that case.)

But ‘the duty to retreat’ means that if you feel threatened you are obligated to try to get away. And in this case, it was Trayvon who was the person who felt threatened. Why didn’t he try to get away? Zimmerman didn’t feel threatened. So he had no duty to retreat.

But it’s probably a fool’s errand to try to reason with Ms. Jackson Lee.

    Maybe some of the more legal minded commenters can elaborate on this issue better than I, but it’s my understanding that the ‘stand your ground’ laws are meant more as civil protection for people who may shoot criminals rather than any self defense need. I think there had been a rash of criminals or their families suing homeowners or civic minded citizens who shot them in the act. These laws are meant to protect these people from civil suits.

    Maybe Jackson-Lee is just trying to protect her constituency of abulance chasing lawyers who donate so much money to the demoncrat party. In other words, more money laundering. Like everything the demoncrats do, It’s all about money and power.

      I think the Stand Your Ground laws are equally effective in shielding citizens from both criminal and civil actions arising out of the need to defend oneself. A civil judgment would be a result of a breach of a duty: legal, fiduciary, etc. For example, I have a legal duty to stop at a stop sign because the statute says so. If I fail this duty, and as a direct result, cause harm to another or their property, I have a civil liability. I also have a criminal liability, albeit a minor one, but I will likely be issued a ticket for the Class C misdemeanor of failing to stop at a stop sign. The two issues are often linked to one another.

      Your point is well received and elaborates on another legal protection for those who have a need to defend themselves in a life-threatening situation. I just don’t think Shirley is smart enough to have thought it out as far as you did. This is purely a racial issue to her. She thinks white people are just shooting black people at wholesale rates and claiming self defense. I’ve seen Shirley’s district, her “constercherents” aren’t lawyers, although many of them are likely familiar with the legal system.

      Equating Jackson-Lee’s IQ to a toaster is an insult to toasters everywhere. Go with a vegetable.
      She has the IQ of a parsnip, and the good sense God gave an animal cracker.

    When Rep Sheila Jackson Lee said don’t condemn the gang-bangers, blame the guns ( trafficked by who else but gang-bangers) it’s like our leader and others who understand criminals vote for Democrats.

    Gang-bangers will just use knives and bombs.
