Girl of 8 seeking divorce

13/04/2008

Sana’a - An eight-year-old girl has sought the help of a judge to seek a divorce after two months of forced marriage to a 30-year-old man in Yemen, said press reports on Sunday.

Nojoud Muhammad Nasser lodged a compliant at a court in the capital, Sana’a, last week against her father who forced her to marry a man 22 years her senior, and asked the judge to secure her divorce.

Presiding judge Muhammed al-Qadhi ordered the father and husband to be arrested after he heard her testimony in which she accused her husband of sexual and domestic abuse. The father was later released due to health problems.

“He used to do bad things to me, and I had no idea as to what a marriage is,” the child-wife told the Yemen Times about her husband.

“I would run from one room to another in order to escape, but in the end he would catch me and beat me and then continued to do what he wanted,” the girl said.

“Whenever I wanted to play in the yard he beat me and asked me to go to the bedroom with him. This lasted for two months.”

Early marriage is prevalent in rural and urban areas of this impoverished Arab country as no law sets the age of marriage.

There are no law that set the age of marriage?

Meanwhile, the “husband” would only need to tell his “wife” three times that he divorces her.

Isn’t Sharia great?

 Update!

From France’s AFP:

Yemeni girl, 8, gets divorce after forced marriage

SANAA (AFP) — A Yemeni court on Tuesday granted a divorce to an eight-year-old girl whose unemployed father forced her into an arranged marriage this year, saying he feared she might be kidnapped.

I am happy that I am divorced now. I will be able to go back to school,” Nojud Mohammed Ali said, after a public hearing in Sanaa’s court of first instance.

Her former husband, 28-year-old Faez Ali Thameur, said he married the child “with her consent and that of her parents” but that he did not object to her divorce petition.

In response to a question from Judge Mohammed al-Qadhi, he acknowledged that the “marriage was consummated, but I did not beat her.”

Yemen, one of the world’s poorest countries, has no law governing the minimum age of marriage.

Nojud was a second grader in primary school when the marriage took place two and a half months ago.

“They asked me to sign the marriage contract and remain in my father’s house until I was 18. But a week after signing, my father and my mother forced me to go live with him.”

Nojud’s father, Mohammad Ali Al-Ahdal, said he had felt obliged to marry off his daughter, an act he claims she consented to.

He said he was frightened after his oldest daughter had been kidnapped several years ago and later married to her abductor. He said the same man then kidnapped another of his daughters who was already married and had four children, resulting in him being jailed.

Dressed in traditional black, Nojud said she would now go to live in the home of her maternal uncle and did not want to see her father.

The girl’s lawyer, Shadha Nasser, said Nojud’s case was not unique. “I believe there are thousands of similar cases,” she said, adding that civil society groups are pressing parliament to set the minimum age for marriage at 18.

What a wonderful culture. So famously protective of women.

Yemen, one of the world’s poorest countries, has no law governing the minimum age of marriage.

They have Islam, don’t they? Isn’t it the perfect guide to life? Doesn’t it tell the faithful how to do everything down to the most minute detail?

Who are we kidding here?

Excuse me, when did the Arabs take over Africa?

  4. wardmama4

Ok, I see my mistake - this is just an African news reporting on something from Yemen. Sorry I got confused. . .

    “Send Janet Reno over there.”
That would, as you know get the kids killed.
She may also be confused with a camel.

  7. pagar

Wonder how long before a Fatwa is issued against the judge.

  8. Sharps Rifle

Why do we let these barbarians exist? Ann Coulter was only partially right in her immediate post-9/11 comments: We should kill their men and convert the women and children to Christianity. It’s not for nothing I call mohammed’s filthy cult of death and pedophilia “islime”…and its followers are the most disgusting vermin on this planet!

Marrying two people when they are 15 so makes sense when it was the dark ages and long lived was age 40, though both should have been 15 in that case, not 15 and 40. In that case it’s just plain wrong; marrying child with someone who should be her father or grandfather makes me sick.

The Crusades are starting to make alot more sense.

It is somewhat ironic that Google runs ads for Muslim matrimonial services on the site whenever we post articles like this.

    A very few.

    But every penny helps.

I do like the idea telling my wife three times I want a divorce! Wait I do not have a wife. This story is so sad and even worse it happens all the time over there in that part of the world but it also happens here too. Just this past week the same thing happened in TX and last year in Utah. It is not just the religion it is also the mentality

  16. DEZ

Yes Brian, It is the mentality, But in the States we frown on it and prosecute it as the crime it is.

  17. pagar

Brian, I tried that link and didn’t find what you were referring to. Any chance there is a better link? Thanks

“Very true Dez. Over there they just stone you to death.”
Thats usually the female victim from what I have read, But child molesters being stoned to death suits me fine.

Thank you Dez. Your right its mostly women but I have read a few things that they stoned the men too. They should stone the child molesters here. I would be first in line to throw a stone.

  23. DEZ

Pass me a stone, Yeah that big scraggly sharp cornered bastard.

  24. Lipstick on a PIAPS

Well, I guess we now know why Liberals love this “religion”. Bill Clinton and the gang would love to be “Married” in this stupid world of Muslim “enlightenment”. Chalk one up for multi-culteralism. ;-)
