Judge Bans Campaign Ad/Political Speech

Judge upholds ban on political group’s ads

BLACK RIVER FALLS, Wis. (AP) — A judge has upheld his order banning a political group from running its radio ads against a candidate for state Assembly in west-central Wisconsin.

Jackson County Circuit Court Judge Thomas Lister on Sunday upheld an order he made a day earlier that says a Middleton-based Coalition for America’s Families must stop running ads that make false representations about Mark Radcliffe, a Democratic candidate for the 92nd Assembly District.

The coalition said Sunday it would immediately appeal the judge’s ruling.

“If Judge Lister’s ruling is allowed to stand, any public official will now have the opportunity to stifle criticism of their public positions, simply by changing them. That would be a sad day for democracy,” coalition spokesman R.J. Johnson said in a news release. Johnson said the coalition contends its ads are truthful and supported by the public record.

The ad says Radcliffe supports a health care plan that would double Wisconsin’s taxes to give benefits to out-of-state residents and illegal aliens. It also says the $15 billion plan would make Wiscon-sin the highest taxed state in the country.

Radcliffe, who is up against Republican Dan Hellman for an open seat, filed the restraining order request Friday.

In a statement, Radcliffe said the ad is false and that he’s trying “to stand up for the rights of the people in this state who are tired of the garbage in politics and the partisan bickering that accomplishes absolutely nothing for the people in my district.”

Assembly Democratic Cam-paign Committee Director Jim Smith said the judge’s ruling “puts a nail into the coffin of dirty politics, lies and misrepresentations.”

“The facts are that candidate Mark Radcliffe never endorsed nor claimed to support free health care for illegal aliens,” Smith said in a statement.

The ad was scheduled to resume today after a weekend break but was temporarily suspended to avoid a contempt of court charge, said Johnson, the coalition’s spokesman. He said an appeal will be filed with the Wisconsin Court of Appeals by the time court opens this morning.

It is reported by a local Wisconsin radio station WTMJ that:

1) The judge was appointed by [liberal Democrat Wisconsin Governor] Doyle in July.
2) The judge practices in Jackson County, as does the plaintiff, Democrat candidate Radcliffe.
3) Lister gave money to both of the liberal candidates for the Supreme Court in the past two races. And that the Coalition for America’s Families was active in both of those races.

Of course the First Amendment to our Constitution was meant to protect political speech. Not pornography or any of the other fallacious things it has been twisted to shield.

And yet it is political speech that has been the most limited by the courts.

And just wait until the Constitutional scholar Mr. Obama gets going.

    The Democrats are learning from their master; why run against your opponents when you can simply have anyone that questions you silenced?

    Appeals court suspends order blocking political ad

    MADISON — An appeals court has suspended a judge’s restraining order that blocked a conservative group from running ads attacking a legislative candidate.

    The decision from the District 4 Court of Appeals means the Coalition for America’s Families can continue running ads accusing Assembly candidate Mark Radcliffe of supporting government-run health care for illegal immigrants.

    The decision stays a temporary restraining order granted by Jackson County Circuit Judge Thomas Lister, who ruled Saturday the group must pull the ad because it was likely defamatory.

    The appeals court says it’s not aware of any case law that would permit the prior restraint of free speech in this case.
