Update from the AP: Somewhere a judge has read that Constitution thing:

Appeals court suspends order blocking political ad

MADISON — An appeals court has suspended a judge’s restraining order that blocked a conservative group from running ads attacking a legislative candidate.

The decision from the District 4 Court of Appeals means the Coalition for America’s Families can continue running ads accusing Assembly candidate Mark Radcliffe of supporting government-run health care for illegal immigrants.

The decision stays a temporary restraining order granted by Jackson County Circuit Judge Thomas Lister, who ruled Saturday the group must pull the ad because it was likely defamatory.

The appeals court says it’s not aware of any case law that would permit the prior restraint of free speech in this case.

Wis. judge upholds ban on political group’s ads

BLACK RIVER FALLS, Wis. (AP) — A judge has upheld his order banning a political group from running its radio ads against a candidate for state Assembly in west-central Wisconsin.

Jackson County Circuit Court Judge Thomas Lister on Sunday upheld an order he made a day earlier that says a Coalition for America’s Families must stop running ads that make false representations about Mark Radcliffe, a Democratic candidate for the 92nd Assembly District.

The coalition said Sunday it would immediately appeal the judge’s ruling.

“If Judge Lister’s ruling is allowed to stand, any public official will now have the opportunity to stifle criticism of their public positions, simply by changing them. That would be a sad day for democracy,” coalition spokesman R.J. Johnson said in a news release. Johnson says the coalition contends its ads are truthful and supported by the public record.

The ad says Radcliffe supports a health care plan that would double Wisconsin’s taxes to give benefits to out of state residents and illegal aliens. It also says the $15 billion plan would make Wisconsin the highest taxed state in the country.

Radcliffe – who is up against Republican Dan Hellman, of Onalaska, for an open seat – filed the restraining order request Friday.

In a statement, Radcliffe said the ad is false and that he’s trying “to try to stand up for the rights of the people in this state who are tired of the garbage in politics and the partisan bickering that accomplishes absolutely nothing for the people in my district.”

Assembly Democratic Campaign Committee Director Jim Smith said the judge’s ruling “puts a nail into the coffin of dirty politics, lies and misrepresentations.”

“The facts are that Candidate Mark Radcliffe never endorsed nor claimed to support free health care for illegal aliens,” Smith said in a statement. …
