Release of Yemeni Held At Guantanamo Ordered

A federal judge has ordered a Yemeni detainee released from the U.S. military prison at Guantanamo Bay, Cuba, ruling that the government relied too heavily on problematic witnesses to make its case that he was a terrorist.

In a 45-page opinion, U.S. District Judge Gladys Kessler said the government failed to prove that Alla Ali Bin Ali Ahmed, 25, supported the Taliban or al-Qaeda. He was arrested in Pakistan and has been held at the Guantanamo Bay prison since 2002.

She ordered the government to enter into diplomatic negotiations to release Ahmed, though it is unclear whether that will work. The United States has hesitated to send Yemenis back to their home country because of its instability.

Most of the evidence against Ahmed was classified, and the Justice Department has not released a public version of its allegations.

In her heavily redacted opinion, Kessler wrote that the government presented a "mosaic" of evidence to back up allegations that Ahmed fought in Afghanistan, received military-style training there, traveled the country with fighters and stayed at a guesthouse in Pakistan with terrorists.

But Kessler ruled that the evidence was weak, inconsistent or too speculative to justify Ahmed’s continued confinement. She wrote that the government "produced virtually no credible evidence" to prove that Ahmed fought U.S. or allied forces…

Federal judges have ordered eight detainees released after they challenged their confinements in federal lawsuits. Three have been sent home.

Meanwhile, even Wikipedia reveals some details that the Washington Post thought their readers didn’t need to know:

Gladys Kessler

Gladys Kessler is an United States District Court Judge for the District of Columbia. She was nominated to the court by President Clinton, a Democrat, and is known as one of the most liberal judges in the D.D.C. Judge Kessler was appointed to the United States District Court for the District of Columbia in July 1994.

After receiving her B.A. from Cornell University and LL.B. from Harvard Law School, she was hired by the National Labor Relations Board. She worked as a Legislative Assistant to Democrat U.S. Senator Harrison A. Williams, later convicted in the Abscam scandal

Kessler is the first judge to consider an appeal that the Executive branch is violating the new Detainee Treatment Act. Lawyers for Mohammad Bawazir argued that the measures Camp Delta authorities instituted to break a six-month hunger strike were abusive, cruel and unusual. Department of Defense spokesmen argued that the Detainee Treatment Act didn’t apply to suspects held captive in Guantánamo Bay, Cuba.

On October 10, 2007, the Washington Post headlined "Judge Orders U.S. Not to Transfer Tunisian Detainee," and reported that Judge Kessler "ruled last week that Mohammed Abdul Rahman cannot be sent [from Guantanamo] to Tunisia because he could suffer ‘irreparable harm."

Oh, and lest we forget, Judge Kessler thoughtfully put a gag order on the ‘DC Madam’ when it looked like she might start naming names of clients who were not Republican.

But why should The Post’s readers know anything about Ms. Kessler’s background?

It’s not like she is prejudiced or anything.

And it’s not like our lives are at stake.

      I was just dreaming of setting up a halfway house for these poor folks who can’t go home, preferably in the neighbourhoods of judges like Kessler.

    She’s trying to get Obama’s attention. It’s all fun and games until one of these detainees blows themselves up here in the US. Some are obviously willing to sacrifice lives during this power grab.

      I wonder if any of these judges have considered the public backlash if one of these liberal heros does committ an act of violence on Americans once released, apart from those we have already picked up on the battle field for a second time. I doubt even the great Obama could save him/her from the angry crowds with pitchforks.

      I would guess that if anything DID happen, we wouldn’t hear about it in the press. Well, we would hear about a disaster but the actual blame for it would be in section F page 20 or possibly, never know what caused it at all.

    Wow…so she:

    1) was a legislative assistant to a senator who was compelled to conspire with Arab criminals against the US;
    2) protected a US enemy combatant from being tried in his own homeland;
    3) is the first judge to hear an appeal from lawyers who are seeking to weaken the US ability to detain combatants;
    3) releases a Yemeni terrorist detained by our military because our soldiers didn’t obtain a judge’s warrant before capturing him in battle.

    Nope, nothing curious about her at all, is there?

    I think if they release him, he should have to find his own way home from Cuba, just give him a couple of bucks for cab fare like they do every other federal prisoner when they’re released. Either that or give him a plane ride to Yemen and give him a parachute packed by the ACME Corp like the Coyote always seemed to get with the anvil in place of a chute.

    My god….what the hell did you write? Every single recipe for pineapple upside down cake that you have?

    Andy Mcarthy was able to say it in 3 pages. Succinct, to the point, direct.

    Oh, wait your a libtard. You have to go on and on and drone until it all becomes just written white-noise so that after the first 20 pages, people just give in and cave.

    I’m sure it’s loaded with the guilt-ridden phraseology that the uber-left uses and more weak logic than a 4 year old trying to rationalize how they got caught with a handful of cookies. The word, “victim” is probably mentioned at least eight times on each of the 45 pages and not about the people this radical muslim probably killed, either.

    Well, I’m sure someplace, where the jazz music plays, and the bongos beat, and the blue cloud of reefer smoke hangs heavy in the air, there are those who are saying, “right on, man.” Unfortunately for her, that place was over 40 years ago and gravity hadn’t taken its toll yet. But what’s truly the most important is that she can feel good about herself.

    Replace her bleached blond hair in the photo. I guess Kessler didn’t make “ali,ali, etc. release his real name. Release the terrorists. She forced the release of 9/11 suspects being held,, but wouldn’t allow the Civil Rights of a white American woman. Gag order placed til noose around her throat. Like she’d really hang her self without giving the D.C. names out.
