Twin Cities Somali advocate heading to NY to help accused pirate

A Twin Cities Somali community activist said he is on his way to New York this morning on a mission to ensure that an accused pirate is treated justly in a court appearance this afternoon.

Omar Jamal, executive director of the Somali Justice Advocacy Center in St. Paul, said he spoke Monday with the parents of Abdiwali Abduhl Wali-i-Musi, the sole surviving Somali pirate from the hostage-taking of an American ship captain.

Jamal said he intends to be in court today with Wali-i-Musi and carrying a letter from his parents in Somalia explaining that Jamal has permission to arrange for Wali-i-Musi’s defense.

Jamal said it’s likely that Wali-i-Musi will be represented by a federal public defender or an attorney arranged by the family, possibly from a civil rights organization on a pro bono basis.

"We need him to get any benefits of this judicial system," Jamal said as he headed to the airport for a flight to New York. "Our primary concern is that the family doesn’t lose their mind."

Ron Kuby, a New York-based civil rights lawyer, said he has been in discussions about forming a legal team to represent the Somalian.

"I think in this particular case, there’s a grave question as to whether America was in violation of principles of truce in warfare on the high seas," said Kuby. "This man seemed to come onto the Bainbridge under a flag of truce to negotiate. He was then captured. There is a question whether he is lawfully in American custody and serious questions as to whether he can be prosecuted because of his age."

Jamal said the parents reached out to his organization because his group has been involved in negotiations regarding a Nigerian ship taken by pirates. That ship’s captain, Jamal says, has a brother who lives in the St. Paul area…

The teenager’s arrival came on the same day that his mother appealed to President Obama for his release. She says her son was coaxed into piracy by "gangsters with money."

"I appeal to President Obama to pardon my teenager; I request him to release my son or at least allow me to see him and be with him during the trial," Adar Abdirahman Hassan said in a telephone interview with the Associated Press from her home in Galka’yo town in Somalia…

What good news this is.

We were so afraid that Mr. Wali-i-Musi would not get the best and most expensive thorough defense that taxpayer money could buy.

(By the way, does Mr. Wali-i-Musi look like a teenager to you?)

Jamal said it’s likely that Wali-i-Musi will be represented by a federal public defender or an attorney arranged by the family, possibly from a civil rights organization on a pro bono basis.

Thankfully, the Star Tribune was far too discreet to bring up Mr. Jamal’s own contretemps with the law.

The federal government has charged Minnesota Somali activist Omar Jamal with violating immigration rules. The Homeland Security Agency has detained him in the Washington County jail. Jamal also faces criminal charges for the same allegations — that he lied to the government to get into the country. Jamal could face deportation or prison, depending on the outcome of the government’s case against him.

St. Paul, Minn. — The government alleges Omar Jamal lied five years ago in immigration proceedings in Memphis, Tenn. The government says Jamal lied about where else he had lived, and used a fake passport to enter the United States.

Tim Counts, the spokesman for the Homeland Security office in Bloomington, says Jamal faces both immigration and criminal fraud charges.

"One is the criminal issue, which could result in fines or a prison sentence. And we’ve also charged him with the same fraudulent acts administratively under immigration laws," says Counts. "Those two processes will be running concurrently, and the result of the immigration procedure is his possible loss of status in the U.S. and his removal from the U.S. The possible loss of the criminal process could be fines and/or jail time."

Omar Jamal, 30, is a native of Somalia who has also lived in Kenya and England, among other countries. He left Kenya in 1997 and moved to Memphis, according to one account, to live with a cousin. He arrived in the Twin Cities in 1999.

Jamal is the executive director of the Somali Justice Center, an advocacy group in St. Paul, where he lives with his wife and three children. He is an outspoken advocate for Somalis, and a frequent critic of their treatment by the U.S. government…

The latest mention of him I have found so far, from an article about famous people from Somalia:

Jamal was convicted in January 2005 of violating immigration rules… He currently faces deportation rather than prison. Jamal denies the charges and intends to appeal his case. The Associated Press reports his sentencing is set for 4/7/2005.

We are not sure what the final disposition of this case has been. But since Mr. Jamal is out walking around large as life, we assume he somehow found a way to beat the rap.

Or maybe, like Mr. Obama’s aunt, he is simply ignoring a deportation order.

The Star Tribune also neglected to mention the background of Mr. Ron Kuby.

Ron Kuby

A disciple of the late radical attorney William Kunstler, Ron Kuby is a New York-based attorney who thinks of himself as a "movement lawyer." He told the The New York Times in 2002, "Movement lawyers live vicariously through their clients. Movement lawyers identify especially with the people they represent." Along with his colleagues at the pro-Communist Center for Constitutional Rights and the National Lawyer’s Guild, Kuby has represented Islamic terrorists, American terrorists, drug dealers, cop killers, and mentally ill assassins

Kuby earned his Juris Doctor in 1983 and then began practicing law. Among his many infamous clients was Colin Ferguson, a black gunman who — on December 7, 1993 — walked up the crowded aisle of a crowded Long Island, New York railroad car, shooting white and Asian passengers. Six were killed and nineteen were wounded. Kuby and Kunstler defended Ferguson in court, introducing a novel argument in his defense: "black rage." They attempted to convince the court that years of living in a supposedly racist and oppressive society had so clouded Ferguson’s mind, that he was not acting willfully when he opened fire on the passengers. Ferguson rejected this defense strategy and dismissed the attorneys, choosing instead to represent himself before the court. He argued, in contradiction to dozens of police reports and eyewitness accounts, that he was innocent of the shootings and had been framed. Kuby and Kunstler then tried, unsuccessfully, to convince the court that Ferguson was insane. The defendant was eventually convicted and sentenced to six consecutive life terms…

Perhaps Kuby’s most notorious client was Sheikh Omar Abdel Rahman, mastermind of the 1993 World Trade Center bombing. "Sheikh Omar would have tried, I think, to prevent the World Trade Center bombing if he had known it was coming," Kuby said in a 2000 interview. Kuby suggested that it was actually the FBI that had built and detonated the bomb, as a pretext for imprisoning innocent Muslims. "The ‘mastermind’ [of the bombing] is the government of the United States,” said Kuby. “It was a phony, government-engineered ‘conspiracy’ to begin with. It would never have amounted to anything had the government not planned it." …

In 2003 Kuby defended another Islamic terrorist: the Washington, DC-area sniper John Allen Muhammed…

An avowed Marxist, Kuby acknowledges the historical failures of Marxism but nonetheless maintains that those failures make no dent in his devotion to that ideology. "Christianity," Kuby analogizes, "has been around for 2,000 years and they haven’t created paradise on earth. Should we throw Christianity out then? Marxism has only been around for 150 years, more or less. So we haven’t created paradise yet."

Kuby joined Ossie Davis, Mike Farrell, and members of the Revolutionary Communist Party, the National Lawyers Guild, and the Center for Constitutional Rights in signing a letter supporting protests and civil disobedience on behalf of convicted cop-killer Mumia Abu Jamal…

Have you ever wondered why these “charity” civil rights organization seldom or never represent anyone who is actually trying to preserve or protect the rights enumerated in the US Constitution?

Why should the (laughably named) American Civil Liberties Union be defending terrorists who have declared jihad upon the citizenry of the United States, for instance?

And why are we helping to fund them with our tax dollars?

    Obama will almost certainly grant the young man clemency if this prosecution proceeds too well. Because after all, they’re cousins.

      We needn’t go to all the expense of a trial for this poor innocent youth. I say we find someone willing to donate a seaworthy row boat to this impressionable youth, give him a carton of MRE’s, tow his boat behind the next merchant ship headed toward Somalia giving him free passage half-way there, and set him free.

      If you’re laboring under the illusion that Obama brought Abdiwali Abduhl Wali-i-Musi all the way to these shores so that justice could be served, I’ve got a bridge you can buy…….cheap! And yes, it was Obama’s orders that brought him here. Any sane person would have turned the little wharf-rat loose half a world away and forgotten about him. If he showed up in the next round of target practice aboard another pirate vessel, so much the better. A thirty-five cent round is a lot cheaper than what it’ll cost to keep the peckerhead here….along with his extended family……while the Obamanation “seeks justice” for him. All in the name of aligning the U S with the international community.

      Doesn’t all of this make anyone besides me want to vomit?

The check is in the mail, I will get three meals a day, dental care, and my family will be given visas to support me during my trial and then we will all live happily ever after in the U.S.A. because of some sort of political refugee legislation pushed through by the messiah!”

    How can Ron Kuby live with himself? No wonder Nancy Grace has such a fun time with him.

    The little slimebucket shouldn’t have any rights inour courts except whatever rights he has in that third world s**thole he came from. ARB had it right, a rope, a yardarm and thou is all we need for this piece of walking feces. He’s a pirate which in my mind equals felon.

    I read in the Washington Times some ships are thinking of either arming themselves or hiring protection services to ride on their ships. We might want to go back to the old days and station a Marine contingent onboard US flagged ships to deal with this scum but I sure our Ignoramus in Chief would be afraid we might violate some poor pirates’ rights. Makes me want to puke.

    Lottery winner indeed. Did you see what his parents had to say? It’s 1700’s Savannah, GA in Somalia today where there are tunnels underneath the city where people were kidnapped and pressed into the Pirate Service. Maybe they have a Pirate’s House restaurant there too and he can get a job there when he gets home. This is the best deal this kid has ever seen in his life.
