Moussaoui chanted and smiled as jury weighed death

ALEXANDRIA, Virginia (Reuters) – While lawyers argued and a jury considered whether Zacarias Moussaoui should live or die, the convicted September 11 conspirator mouthed al Qaeda fight songs, cursed America and smiled as witnesses recounted the deadly hijackings.

Moussaoui seemed to savor moments when he could shout "God curse America" and "God bless Osama bin Laden." But he was careful to do so out of earshot of the jury that will decide if he is to be executed.

Moussaoui, 37, who last year pleaded guilty to conspiracy in connection with the September 11 attacks, is on trial to determine whether he gets the death penalty or life in prison.

The sentencing trial started March 6 and could last up to three months.

He has refused contact with his lawyers and repeatedly cursed them and the United States after the jury and U.S. District Judge Leonie Brinkema filed out of the courtroom.

Seated apart from the court-appointed team of lawyers, Moussaoui — an admitted al Qaeda member — has spent most of the trial so far leaning back in his chair and stroking his long, bushy beard.

In a green prisoner jumpsuit and white cap one day, the Frenchman of Moroccan descent mouthed the words to al Qaeda fight songs played on a videotape.

He smiled when a prosecutor read four separate accounts of the four airplanes that were slammed into the World Trade Center, the Pentagon and a Pennsylvania field on September 11, 2001, killing nearly 3,000 people.

"God curse America!" Moussaoui yelled at a trial break.

"Osama bin Laden! Jihad," he chanted later.


Brinkema has reprimanded Moussaoui, the only person convicted in the United States in connection with the hijackings, for his outbursts in court and warned he would have to watch the trial on closed-circuit television if he was not quiet.

He glared and took notes when one of his lawyers, Edward MacMahon, depicted him as an inconsequential part of al Qaeda and an incompetent pilot who never would have been able to carry out a hijacking.

MacMahon noted that Moussaoui may have talked about wanting to kill infidels, but he never harmed anyone during the months he was in the United States before being arrested after raising suspicions at a flight school in August 2001.

"That, ladies and gentlemen, is Zacarias Moussaoui in a nutshell, sound and fury, accomplishing nothing," MacMahon said.

On the first day of the trial, Moussaoui did not acknowledge his mother, who traveled from France.

As she tried to attract his attention, Moussaoui glanced at her, and then quickly looked away with a look of disgust on his face. His mother, Aicha el-Wafi, who has been distraught at times, said, "It is not my son. It’s someone else."

The government is trying to prove that Moussaoui knew about the September 11 attacks and lied to the FBI after he was arrested three weeks before them. Moussaoui’s lawyers say it is unlikely he knew anything that could have helped the FBI prevent the attacks.

Moussaoui pleaded guilty to conspiracy but said he was not part of the September 11 plot. He said he was meant to participate in a second wave of attacks by flying an airplane into the White House.

Family members of September 11 victims spent much of their time in the courtroom craning to see Moussaoui.

"Look, there he is," one woman said.
