NJ man sues Benjamin Moore over ‘racially offensive’ paint names

NEWARK — A New Jersey man named Clinton Tucker is suing former employer Benjamin Moore, claiming discrimination regarding the paint company’s colors "clinton brown" and "tucker chocolate."

Tucker, who identifies himself as an African-American man in the lawsuit filed in Essex County court in Newark, said he was hired in June 2011 in the digital marketing department but quickly found himself being discriminated against, according to a write-up of the filing on CourthouseNews.com.

According to other reports, Mr. Tucker also says he is a homosexual. So it’s a wonder he didn’t find some paint names that were discriminatory toward gays, as well.

Tucker is seeking damages for discrimination, retaliation and a hostile work environment, according to the suit.

He claimed that when working on the online arm of Benjamin Moore’s campaign for their Williamsburg color collection, he learned of the new color "tucker chocolate," which the suit called "extremely racially offensive." The Williamsburg collection also has colors named tucker orange and tucker gray.

The St. George Tucker House is one of the most historically recognized homes in Williamsburg VA. It dates from 1716 and is now situated on Market Square and serves as a reception gathering place for Colonial Williamsburg donors.

Tucker then learned of the existing color "Clinton Brown," which a co-worker pointed out to him as a joke.

Clearly, that was meant to be a dig at our first African-American President.

"Despite [Tucker's] repeated complaints and protestations to BM management about these appallingly racial color names, no action was ever taken by Benjamin Moore to change the names of these colors," according to the suit.

Tucker also claimed that he was demoted while white co-workers were given promotions, and that his request to take off work on Martin Luther King Jr. Day was ignored.

Benjamin Moore eventually fired Tucker in March, but retained his "two white, blonde-haired and blue-eyed subordinates," according to the lawsuit…

They sound like ‘white devils.’

    I’m sure there aren’t any other people in the world named Tucker… or Clinton. (I wish). And if there are ANY other people named Tucker or Clinton (and what are the chances of that) I’m sure they’re all african-american and equally offended. Every single one of them. God, what if his name was Hershey?

    This guy is an opportunist moron looking for a payday. White, brown red, yellow, green or F*****g Tucker Chocolate… he is moron. It’s just too bad it’s not happening in Florida. I hear the punching judge is back in court. This guy and the lawyer that took the case could both use a pop in the pie hole.
