Health Care Call Center Lawsuit Alleges Unpaid OT

Customer service workers at a call center for insurance exchanges established under the federal health care overhaul have sued their employer in federal court, saying they were forced to work unpaid overtime.

The nine workers at a Boise facility who brought the suit against Maximus Inc. say the case could potentially apply to thousands of employees, and they’re asking a judge to award damages exceeding $5 million…

Oh, the irony. Especially, since Obama is spending so much time harping on income inequality and/or the minimum wage. (In fact, it’s almost as ironic as Obama not paying the interns at the White House.)

The workers say they were wrongly classified as exempt from overtime and required to work up to 60 hours a week, frequently missing lunches and breaks, in violation of the federal Fair Labor Standards Act.

Hey, Obama-Care ‘doesn’t need no stinkin’ Fair Labor Standards Act.’ But lets hope their lawyers made sure Obama didn’t make them exempt with some executive order.

"An employer’s obligation to pay its employees overtime wages is more than a matter of private concern between the parties," wrote attorney Howard Belodoff in the lawsuit. He stated that "members of a modern, humane society are not simply indentured servants but are entitled to work a livable number of hours at a livable wage."

So Obama-Care refused to pay a living wage? Again, the irony.

The nine employees are all either trainers or first-level supervisors… The workers say they have no real managerial powers and should have been classified as hourly workers and paid overtime.

They sure sound like they were Navigators. Or at least trainers of Navigators. But, for some odd reason, the AP never uses the term. Anyway, you have to wonder how many of them are ex-ACORN or from the SEIU.

Belodoff said after multiple complaints Maximus agreed to re-classify the workers at the Boise call center as hourly, but that the company also reduced their wages and benefits and refused to pay the workers double damages for the lost overtime wages as required by federal law.

Again, Obama-Care is above the law.

The workers say it’s difficult to determine just how much unpaid overtime they are owed because the company prevented them from filling out accurate time cards when they were classified as salaried workers.

Maybe the company was just trying to avoid having to pay the employer mandate for fulltime workers under Obama-Care?

    And they do hire felons, but they screen them first. That’s Obama’s regulations on tax breaks for hiring minorities, disabled, vets that haven’t been able to find work after 6 months is towards the end of the list.

      They are based in Chicago and Wisconsin. And yes, they are encouraged to hire felons, and at least disabled vets who haven’t been able to find work for 6 months.

      We are getting food packaging from middle-east garbage recycled, particularily
      the plastic that is 100% paper board, which I still don’t understand how cardboard and paperboard can turn into plastic without adding crude oil.

      We’ve known forever that anything distributed by the USA does not mean made or grown in the USA.

      But, now we are mislead with new logo “packaged” in the USA, because it doesn’t mean the what the USA is packaging it in comes from the USA.

      I discovered a little stationary desk I have that I thought was a imitation, but really an
      antique oak and looked up the company and their little company had just closed their doors. Their website had pictures over the years. They weren’t like an expensive luxurious furniture store, but practical wood when furniture was made of wood.
