Obama aides push back on venue for terrorism trials

WASHINGTON (Reuters) – The Obama administration bluntly urged the Congress on Thursday to steer clear of directing where terrorism suspects should be prosecuted, pushing back against efforts to require military rather than civilian trials.

A bipartisan group of senators has offered legislation aimed at forcing the administration to prosecute terrorism suspects, like the self-professed mastermind of the September 11, 2001 attacks, Khalid Sheikh Mohammed, in special military commission trials instead of traditional criminal courts.

U.S. Attorney General Eric Holder ordered Mohammed and four alleged co-conspirators to be tried in a criminal court in Manhattan. But concerns by some lawmakers about security costs and granting full legal rights to the suspects have forced administration officials to reconsider.

Holder and Defense Secretary Robert Gates wrote leaders in the House of Representatives to express their opposition to legislation directing how and where to prosecute the cases.

"The exercise of prosecutorial discretion has always been and should remain an Executive branch function," they said in the letter to House Speaker Nancy Pelosi and Republican Minority Leader John Boehner.

"We believe it would be unwise and would set a dangerous precedent for Congress to restrict the discretion of our departments to carry out specific terrorism prosecutions," Holder and Gates said

How is that for chutzpah

Didn’t Mr. Holder’s own law firm, Covington & Burling, spend the last seven years of the Bush administration trying to close down the military tribunals at Guantanamo in order to give their terrorist charges civilian trials in federal court?

Moreover, didn’t the Democrats in Congress and on the Supreme Court do everything they could to interfere with the “prosecutorial discretion” of the Executive branch when it was in the hands of President Bush?

If hypocrisy were an Olympic event, the Obama administration would be out there celebrating with the cigars and champagne.

    What I read into this is barry dictating how he wants things done. He doesn’t want to hear reasonable arguments. He wants it his way. He is quickly showing himself, through his frustration, that he is not an American. He is a hopeful dictator.

      I think you are right on this Rusty. And he will be sure to frame his will behind his little ‘useful idiots’ so as to avoid responsibility for the consequences. You know when these terrorists get off on some technicality.

      It can’t be more crystal clear that he will do anything to protect his muslim buds.

      I keep remembering right after 9/11 when some muslim boasted that they would not stop until the star and crescent flies above the White House. I laughed at the time at his hubris. I’m not laughing now. It’s all but done. We are only missing the flag.

      Let this arrogant, petulant little child throw his tantrum. Give him his way, just don’t give him the means to achieve it. What a perfect opportunity to exercise pay-go. Have your show-trials wherever you wish, dipstick, but not on the public’s dime. And if he insists on implementing his brand of stupidity, undertake an unceasing barrage of reminders about just who is thwarting the will of the people.

      Holder is a criminal. For years his lawfirm employer provided legal defense, pro bono, for the very terrorists he is now charged with prosecuting. He should recuse himself due to a conflict of interest. That’s #1. Number two is, he should be prosecuted for treason for failure to fulfill the oath of office he took to uphold and defend the Constitution.

      Obama demands??!! Hey Barack, (while extending the universal one-fingered salute) perch and rotate you pompous gasbag!

He’s acting like a 3 year-old “I want…I want…I want…I want!” I don’t think he’s heard the word “no” much in his priveleged life and now that he is hearing it, he doesn’t know what to do other than throw a tantrum. If he were my child, I’d paddle his butt and send him to bed.

    Yep, the Congress wanted to intervene, investigate, shut-down, filibuster every single thing George Bush did and said, yet here we are 1 year later and it’s: “Stop doing what you did to Bush!”

    I think this is why Republicans sat on their hands during voting season (like I did). We wanted to punish the Republicans for being arrogant when they had the power to govern the way they knew they should, AND we knew what would happen with an all Democrat Congress and White House—a comedy of errors to show the public how screwed up they really are!

    ….check out the latest approval ratings….we knew that would happen.

    Obama snagged war criminals from the military and put them into the judicial branch, congress considers giving war criminals back to the military, and Obama wants to bring up Executive branch precedent?

    Senator Grassley blasts president and Holder in letter that terrorists court is more than our own military recieve, questions the 500 million Obama requested for Thomas facility in Illinoise & reminds him of our Fore-Founding Presidents of the United States of America’s handling enemy combatants along with why the regulations formed in 2005 are being ignored, to include now holding a different trial for U.S.S. Cole terrorists. Great letter.

    I think it’s the public not complaining about the Terrorists trials!. I think Obama might believe that everyone who voted him agreed with everything he said. ne was for. Obama, most people are not for everything Gitmo thing is something Obama has in his head

    Perhaps tea-party theme should be changed to dress up like muslims with signs “no taxes to terrorists in USA”. Homeland Security & Pelosi wouldn’t call muslim tax protestors extremists or astro-turf. Because, as attacks increase as they did Obama’s first year, the amount of money for specialized trials shows will end up skyrocketing.
