Some articles speak of releasing the prisoners. No word of where they’d be released (most countries don’t want them), so will it be HERE? Have we gone through the looking glass into some alternate universe or something, that terrorists would be released, while a man who tried to fight them is prosecuted?

And it doesn’t help at all to consider that McCain wanted to close down Gitmo too.

I think I’m going to be ill. For at least 4 years.

For, on one hand, he must appear to acquiesce to his base and close Gitmo. On the other, he cannot wave a hand freeing the enemy combatants from due process (we are not an empire and he is not an Emperor, yet…) At that, I believe, is what the Obama adminstration learned between the oath and the governance – even the President is constrained by the rule of law. This, of course, came as a shock to a man that hasn’t taken an active role in enacting law…

Unfortunately, we arrived at this junction by way of the same benighted liberalism that declares that enemy combatants are afforded the same protection under the law as the very same citizens they were trying to kill. In a move of due process, the Supreme Court ordered military tribunals for the enemy housed at Gitmo. This was a mistake. Enemy combatants are not afforded the priviledge of due process, precisely because they have acted outside of the protection of the law – A similar scenario would be if pirates took the option to sue for naval protection and peace once caught in the act of piracy.

However (and here is Obama’s conundrum…) once they are classified as falling under the protection of due process, the process must complete itself. One cannot (without pardon) escape the process due. And tus, the only recourse is to delay the process. However, this opens a Pandora’s Box – as the protection of due process also gives the right of speed.

Couple this with the liberal desire to treat terrorism as criminality alone, allows the administration to move from the military courts to the civilian courts (the precedent is already set…), and thus effectively tying the hands of the Obama administration as regards to prosecuting the enemy combatants – for if they are outside the purview of the military, the civilian courts cannot judge cases outside of their jurisdiction. And Afghanistan and Iraq are far outside of civilian court jurisdiction.

Which is exactly where the Obama administration wants to be – closing Gitmo, treating terrorism as a criminal act alone, and releasing the enemy combatants to their respective countries of origin.

The terrorists housed at Gitmo will be released within the year…

That should be worth at least an Alderman’s seat for the angry, but otherswise wholesome terrorist.

Judge OKs Guantanamo suspension sought by Obama

GUANTANAMO BAY NAVAL BASE — A military judge has agreed to President Barack Obama’s request to suspend the Guantanamo war crimes trial of Canadian Omar Khadr.

It is the first in a series of delays sought by Obama as his administration reviews the legal system for prosecuting alleged terrorists.

The written order came Wednesday in the Khadr case. He is accused of killing an American soldier with a grenade in Afghanistan in 2002.

Army Col. Patrick Parrish, the judge in the case, issued a written order granting the 120-day suspension without a hearing.

Later, a judge is to consider suspending the case of five men charged in the Sept. 11 attacks.

Meanwhile, I was one of the ones saying ‘wait and see’, and I think it was more a matter of hope than belief (ironic, huh?). I had some small hope that even a liberal would have some interest in the continued existence of our nation and our constitution–because otherwise, it’s up to the Republicans in Congress to keep him from sending our country into the gutter, and you know what what means….

We are so screwed.

. BillK is right….they dont have to do anything now, the democrats are gladly achieving their wildest dreams for them, and to be honest, they are doing a much better job of destroying our economy than the terrorists ever could hope to.

The main problem is, one can shoot a terrorist. We will have to endure the Quislings in Congress instead, and pay for their greed over and over and over again.

I fear this action signifies the new administration will move us back to the pre-Bush fantasy that terrorist are simply criminals, not unlawful soldiers bent on attacking innocents for political motives.

Obama’s policies will achieve that nicely, so there’s little need for al Qaeda to act at all at this point; all they need to do is sit back and watch the next eight years and laugh.

We will be proven right. Sometimes the worst is best for the long haul. In retrospect, we all would have been better off if al Qaeda had succeeded with another 9/11-type assault. Because Bush did such a good job protecting us, he is despised, we’ve mostly forgotten about reality, and have lapsed back into our former sleepwalking state. People have to learn the hard way if they refuse to learn the easy way.
