Administration opposes Arizona law that penalizes hiring of illegal immigrants

The Obama administration on Friday urged the Supreme Court to review and set aside an Arizona law that sanctions employers who hire illegal immigrants, saying it would disrupt the "careful balance" that Congress struck in federal immigration law

The law being challenged, the Legal Arizona Workers Act, imposes tougher sanctions than federal law for hiring illegal workers. If the court chooses to hear the case, its ruling could show how receptive the justices would be to arguments that enforcing immigration laws is a federal responsibility that cannot be usurped by the states…

The administration, in a brief submitted by Acting Solicitor General Neal Katyal, said federal law should preempt state efforts.

The Arizona law would "disrupt a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country," Katyal wrote…

How on earth could it hurt to have a state enforcing federal law? Of course this clearly puts the lie to Mr. Obama’s earlier pretense that he was shifting enforcement away from the ‘worker’ and to the employer.

In truth, Mr. Obama doesn’t want to enforce any of our nation’s laws against illegal aliens.

He wants to get as many of them into our country as possible in the hopes that they will help him and the Democrats hold onto power.

    For not only are you proving that you don’t know anything about, well, ANYTHING, you are also now proving you know nothing about the law. Seems you’re not much of a lawyer, either. Harvard-educated or otherwise.

    In fact, you’re not much of anything, are you? Except perhaps a very practiced liar and agitator.

    That’s the oath the President takes when he is sworn in.

    and here is Article 2 Section 3 of the Constitution:

    Section 3 – State of the Union, Convening Congress

    “He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.”

    Repeat: HE SHALL TAKE CARE THAT THE LAWS BE FAITHFULLY EXECUTED

    How does this guy get away with obviously violating his oath of office and the Constitution?

    My teen son is looking for job. Principal honor roll, etc.
    Went to two national large stores. One hired an Asian worker who could say only smile. Didnt’ know what “wash clothes, shrink” not one word.
    He went to well known ice-cream grocer near by, they ended up hiring a very rude, mean faced Mexican worker who could barely speak a word.

    These are not small businesses. Got my drivers license renewed and it has added several new symbols, held to the light a certain way, because they
    are so good at using fake ID’s.
    These wealthy stores, hotels do not have to worry about getting in trouble because in my town, they just say it’s not their fault their license was fake.

    They can’t even cut wood because they don’t know how to measure.

      But this is the world they are building. One where ability doesn’t count. But it’s actually more than that.

      Race isn’t really the factor that counts either. Nor is need.

      What counts is politics. And in this case, the businesses that hired the incompetants rather than your son are pleasing the administration. If they do that, it won’t matter that their level of service will degrade. It won’t matter that their customers will be unhappy. The businesses will stay in business, and the top people will continue their life of splendor. If they don’t please the administration, they won’t stay in business, and the top people will quickly fall from wealth to be just like the common folks. It’s that simple.

      That’s how fascism operates. Power talks. Businesses that want to be in business jump.

      But it isn’t entirely coincidental that your son was rejected for an Asian and a Mexican. But it also doesn’t have anything whatsover to do with redistribution.

      It’s about political support. Votes. Redistribution is a smokescreen to trick the rubes.

      That’s why they are fragmenting the country in every way they can. They don’t want people to be able to depend on their family, their church, their neighborhoods, their schools. They want people to be totally dependent on government. Because when they are, they are afraid to vote any other way than for the people in power.

    This is a craven attempt to remain in power, and it should be viewed as what it is. It’s about Democrat votes, and to hell with the law.

    The logical conclusion is to exempt illegal immigrants from the penalty of law based on race. And it’s so unfair. The same legal protections should be given to, say, black people, for example, who can justifiably claim that they are not being afforded equal protection under the law. Why, it’s racism, pure and simple, isn’t it?

    This is so wrong headed I can’t believe Mr. Obama was elected president.

    Someone needs to remind Obama that when he swore an oath to protect, and defend, the Constitution of the United States, it included Article IV, Section 4 which reads as follows:

    “The United States shall guarantee to [b]every[/b] State in this Union a Republican Form of Government, and shall [b]protect each of them against Invasion;[/b] and on application of the Legislature, or of the Executive (when the Legislature cannot be convened) [b]against domestic Violence.[/b]

    Obama is neither protecting EVERY state from invasion, nor is he protecting American citizens from domestic violence committed by illegal immigrants against them.

    I wonder if Obama will now tackle Massachussets, who is trying to pass a law that, in essence, is much like Arizona’s law regarding hiring illegal immigrants?

    Now we learn that Obama has declined (refused) to meet with Governor Jan Brewer (R-Az) next week. Seems he is just too busy hobnobbing with foreign dignitaries (trying to regain the Jewish vote by meeting with Netanyahu again after his shabby treatment of Bibi last time) and holding a White House concert with Paul McCartney. You see, a president DOES have to have priorities, and Arizona is not one of them.

    Tennessee has the worst flood in 500 years and Nashville was underwater. But that doesn’t hold importance except for Memphis, the only blue area in a red state.

    Louisiana is dying and the oil spill continues. But Barbara Boxer fund raisers, golf and an odd visit to Chicago seem more important. After all, The Won has spoken and he said to “Just plug the damn hole.” Oddly enough, it seems that not everything in the world revolves around this man.

    Heck, how could Barry Soetoro other than support those who hire illegals – i.e. illegitimate job applicants and later, equally illegitimate holders of jobs/ sources of gain that should be reserved only to America citizens and legal aliens?
    Very simple – Soetoro himself is someone who lives in the anxiety of being caught as the illegitimate US president he is, who managed to trick the system and now is enjoying a well-being which would have otherwise been inaccessible to him – be it in his native Kenya, or as, gosh… here, but just as perpetual junior senator from Illinois, with a crappy minimum of airtime –

    And the United States pays for this, and dearly so –

    When they DON’T want to do something, there are excuses excuses excuses. When they want to do something, it is crammed down our throat.

    “We can’t put 14 million people in jail….” –No kidding! But they can be deported, fined, and people who allow them access to services fined. When doors are closed to them, they will have no choice but to leave.

    “We are a nation of immigrants!” –A nation of LEGAL immigrants.

    Ugh, Democrats are going to turn this country into Detroit if they can do it.

      I’ve always loved the argument that we can’t put them in jail. Why the hell not? Maybe we can’t put all 14 million of them in jail, but if we catch ’em, we should be able to jail ’em, and I’m sure we could catch enough of them to scare the rest of them into going home (or to San Francisco).

      And what’s this catch and release crap that’s been going on. These people aren’t widemouth bass in government streams, they’re illegal aliens!!

      Road gangs wearing pink sound like a great idea to me. More prisons. More prison guards. More jobs. There we go. Solves 2 problems at once.

      OBlamer won’t enforce existing law because he doesn’t agree with it. And he’s so much smarter than the 70% of the US population that seems to agree with the Arizona law. It’s political posturing pure and simple. I’m just waiting for the amnesty bill to be jammed down my throat right next to healthcare.

    The U.S. Chamber of Commerce is one of the plaintiffs. (The case is Chamber of Commerce v. Candelaria.)

    One of the defendants is/was Janet Napolitano.

    Go figure.
