Pelosi: Obama Should Raise Debt Limit Directly, Go Around Congress

House Minority Leader Nancy Pelosi has changed her public position on an issue that divided Democrats during the fight over raising the debt ceiling last summer. She now says that President Obama should use the 14th Amendment to raise the debt ceiling by fiat — to preserve the country’s credit rating and avoid another economically harmful brinksmanship over the country’s borrowing limit.

And this comes on the heels of her approval of Obama’s bypassing Congress with his backdoor amnesty ‘executive order.’

“I would like to see the constitution used to protect the country’s full faith and credit,” she told a handful of columnists at a roundtable. According to Matt Yglesias, “She didn’t offer a legal argument in favor of the position, but argued on policy grounds that ‘you cannot put the country through the uncertainty’ again, noting that America’s sovereign debt was downgraded by ratings agencies in the wake of the standoff even though it was successful resolved.”

This of course is an absurd ploy that Bill Clinton raised during the Debt Ceiling debate last summer. And it was ignored then for being pig ignorant of the Constitution.

The provision in question, Section 4 of the 14th amendment, was meant to ensure that the US Treasury only paid the foreign debts incurred by the Union side in the Civil War, and not the debts of Confederate states.

Here is the clause: “The validity of the public debt of the United States, authorized by law, including debts incurred for payments of pensions and bounties for services in suppressing insurrection or rebellion shall not be questioned.”

In other words, the southern states could not stop the north from paying its war debts, even though the federal treasury was not paying theirs. And, naturally, it has nothing to do with the current debt ceiling debate.

Even the hard left TPM has to admit as much:

Many progressives — including some high-profile members of Congress — urged Obama to short circuit the contrived crisis by taking matters into his own hands. Even Bill Clinton said he would’ve invoked the 14th amendment and dared Republicans to stop him.

But most higher profile Democrats in Congress were wary of over-interpreting the Constitution. Top legal scholars and practitioners, of a variety of ideological leanings, expressed doubts that the 14th Amendment gave the president such wide latitude, and warned of potentially far-reaching consequences if the he took such a unilateral move. Obama administration lawyers reached the same conclusions

But just think what this says about Nancy Pelosi. She is begging Obama to ignore Congress. To usurp them and the Constitution. She is begging him to take away Congress’s primary power, which is the power of the purse.

And just a year ago and a half ago she was the Speaker of the House. The most powerful member of Congress.

It is terrifying that so many of our leaders are eager to destroy the carefully crafted separation of powers that have kept us from going down the path of a dictatorship that most republics have followed.

But Ms. Pelosi is only too eager to give away our entire system of government, if it will help her hold on to power.

    Ah, Madame Defarge, my little sans-culotte, my tricoteuse, how goes your knitting today? Hear how fondly she speaks of the Constitution! How quaint. But unfortunately the Constitution has been dead for many years.

    If I had to put a time and place on it, I’d say it died on Cemetery Ridge on 3 July 1863. But it may have died a bit earlier, say, on 15 Apr 1861 (Lincoln’s call for troops to invade the Southern and Border States).

    There was some hope for restoring a semblance of the Constitution up until LBJ and his Great Society. But not since then.

    Certainly not after the Immigration Act of 1965, when loss of American sovereignty and our slow conquest by foreign peoples became practically inevitable.

    Thereafter it was just a matter of time before some tyrant like Nerobama, with his sidekick Madame Defarge, would come along to drive in the final nails.

    Today the USA has become just another banana republic . . . a bigger, shinier, more spectacular Nicaragua, but not quite yet in the same league as Venezuela.

    Although we’re getting close. Very close.
