With First Black Attorney General Come Expectations That Justice System Can Change

For decades, the face of the criminal justice system in this country has been black and male: hundreds of thousands locked behind bars, arrested in disproportionate numbers and facing execution at rates far greater than those for the general population.

This week, Eric H. Holder Jr.’s swearing-in as the nation’s first black attorney general and its top law enforcement official came weighted with heavy expectation that the system could change…

Civil rights advocates are already outlining a long list of priorities, including changing laws that lead to disproportionate prison terms for blacks, ending racial profiling and stepping up the policing of discrimination in employment and housing.

"The most important thing is that we have a person who gets it," said Benjamin Jealous, president of the NAACP. "He understands that the purpose of incarceration is not just punishment and protection but it is also redemption. He understands that people shouldn’t be targeted because of what they look like but because of what they do. He understands that enforcing civil rights serves the interest of law enforcement. It’s not about what he looks like, it’s about what he believes." …

Fixing decades of perceived injustices is a difficult task at any time but will be especially challenging for Holder now, when government budgets have tightened and scarce money is allocated to national security and defense efforts. ..

In public statements since his nomination, Holder has emphasized civil rights enforcement..

"As someone who witnessed the civil rights movement and whose family members literally suffered through the evils of segregation, I hope I can bring a unique perspective to the department," he said. "This department has played a historic role in civil rights over the years, and I owe it to those who came before me and to the American people I serve to oversee a vigorous enforcement program that deals with the realities we confront today." …

In his time away from the office, friends say, Holder worried about young black men caught up in the criminal justice system…

President Obama and Holder have vowed to restore public faith in the department, which was plagued by political hiring scandals during the years that George W. Bush was president. Last month, Inspector General Glenn A. Fine exposed hiring abuses and racial insults at the civil rights division, underscoring persistent complaints from Democrats that it had lost its way as the nation’s premier protector of the rights of African Americans

For criminal justice activists, a pressing concern has been sentencing disparities for convicts caught with crack cocaine versus powder cocaine. Possession of crack carries longer criminal penalties, and 80 percent of people prosecuted for crack offenses have been African American, according to the Sentencing Project. Obama has said repeatedly that he wants to end the sentencing disparity

The sentence disparities have combined with social and economic factors to lead to the increasing number of African Americans in prison, a figure that has grown from 100,000 in 1954 — the year of the Supreme Court’s seminal school desegregation case — to 900,000 today, according to the Sentencing Project, a research and advocacy group.

"When we look at the prison system, it’s a much worse situation than we had seen before the rise of the modern-day civil rights movement," said Mark Mauer, executive director of the group. "If current trends continue, one of every three black males today can expect to go to prison in their lifetime. It is one in every six for Hispanic men."

Locally, four out of five D.C. prisoners are black men

Oddly enough, the Washington Post neglects to mention that the Sentencing Project, whose Press Release they have published, is largely funded by that penal reform expert, George Soros.

And of course, given that these are the wishes of Mr. Soros, they are already part of Mr. Obama’s agenda.

Obama and Biden will ban racial profiling by federal law enforcement agencies and provide federal incentives to state and local police departments to prohibit the practice….

Eliminate Sentencing Disparities

Obama and Biden believe the disparity between sentencing crack and powder-based cocaine is wrong and should be completely eliminated.

Expand Use of Drug Courts

Obama and Biden will give first-time, non-violent offenders a chance to serve their sentence, where appropriate, in the type of drug rehabilitation programs that have proven to work better than a prison term in changing bad behavior.

What Mr. Soros buys, Mr. Soros gets.

    I’ve been making this argument for a while now and I truly believe replacing the father in the home with the state has led to these wonderful figures that were cited in this piece. The chapter on “Single Mothers” in Ann Coulter’s book Guilty, explains the disparities on this topic.

    When this government lifts the cocaine powder to crack laws look for an explosion of the drug on the downtown streets of every major city in this country. I mean it’s already pretty bad, but this will literally place dealers on every block because they won’t be very concerned about a citation. The dealers will be able to flaunt this in the face of the police. This will also lead to a considerable amount of police officers to quit, because what they do, won’t have the slightest difference. Call me crazy, but these morons don’t have a clue what they are doing!!

      Police officers quit? We can only be so lucky! Maybe then people will decide to defend themselves like the Constitution told them they should be doing. Give your security to the state, and there is no reason to have a gun, and no reason to defend yourself.

      I would prefer anarchy that the police-state.

    The fact is according to the FBI uniform reporting statistics blacks commit more crimes than whites and get caught more often.

    With any of them, truth has nothing to do with it. The monstrous idea that crime and punishment should be represented in prison based on considerations of demography is consistent with the loony leftist philosophy. The Progressives will forever be pandering for votes. It doesn’t matter who they get them from–or what they have done. This will no doubt hasten civil strife that Soros would relish.

    1st, the obvious reason more blacks are in prison is simply because more blacks commit crime.

    2nd, what do you expect people to do in this country when you make everyone a criminal and the injustice system keeps itself well oiled with your money? You CAN’T get a job, once you have a record. Your only alternative is suicide. Since many people would rather live, the criminals prey on you, or sell drugs.

    Reform, prison, education…..none of that matters. Once you are hung out to dry by our injustice system, you have no money, you have no job, and you can’t get either one after that.

    What do you expect?

    The reasons for the stiffer punishment on crack cocaine has nothing to do with race. It has been far more found to lead to immediate dangerous crimes when the user, uses it. It is a quick high, and quick down, and so the criminals are more apt to go right and robb or kill someone. There absolutely should be stiffer penaltie for crack, just as a less crime for marijuana. It’s just very difficult for police to do something about this rampant problem mostly seen in the afro-american community. If Obama wants crack out of the hoods, he might havve to take stronger police action, but then the blacks might call this racism and infringing on their privacy and rights. They really need to do something about it. It is extremely dangerous, addicting. Criminals get out, and go right back to it.

    A long time ago I did a paper for a JD (that’s juvenile delinquency not law) class, I was in one of my idealistic phases and insisted on doing a presentation that race had nothing to do with JD stats. My professor would only approve if I accepted that if at midterm, I did not have enough sources I would come and change my topic stance (he did not believe I would ever find enough proof). Well I did the research and guess what – all these years later Ann was right.

    The 3 main sources I had were The Chicago Study (how ironic is that?!?) which had been going on since 1920 ( I do not know if it is still going on, no longer in that profession study and I do know that both of the original researchers are dead) – that proved it was not racial but socio-economic status that affected crime. The Pittsburgh Study that showed that families with a female dominated house-hold had the most JDs and The University of Maryland (I thought it a nice touch that the very college I was going to was about to prove him wrong) which also proved that stable two heads of house families were less likely to produce JD.

    Not a thing – even when some of the researchers tried to adjust – had to do with race. Go figure.

    And if you are set-up from the gitgo by your ‘cultural standards’ – is that anyone (or any other race’s) fault?

    So Soros’ plan, I mean Holder and Obama’s plan, to right these ‘injustices’ is… If a black man commits a crime, and is convicted and sentenced to prison, then the Soros/Holder/Obama trio correct this ‘perceived injustice’ by randomly selecting (by lottery, of course) a white man to serve the sentence instead…? I really wouldn’t doubt it. I’ve said since the beginning, Obama will set back race relations by 30 years (at least) and Obama will virtually eliminate any chance blacks had for advancing out of their trap of poverty. Of course, I’m sure I’ll be called a racist by someone for saying (writing) so.

    Most black criminals prey upon black crime victims. In fact almost 90% of black murder victims are killed by black criminals. Rather then wonder why 1/2 of America’s imprisoned murderers are black you should ask why the low conviction rate results in only 1/2 when over 1/2 of America’s murder victims are black. Do those black crime victims really matter? Not when you are selling racism.
