At issue is Emanuel’s residency. Illinois election laws dictate that a candidate is only eligible to run for city office if he or she has been a legal resident of that city for a year prior to the election. For the Chicago mayoral election, this means Emanuel would need to have been a Chicago resident since February 22, 2010.

Election attorney Burt Odelson told Chicago radio show hosts Thursday that "the law is clear" in this case. "He rented his house out in September ‘09 and has not been back since, and has no residency in Chicago," Odelson said on WLS’s Roe Conn Show. Odelson reportedly has ties to two probable Emanuel opponents in the mayoral race: state Senator James Meeks, a prominent pastor in the city’s black community, and Cook County Sheriff Tom Dart.

Indeed, had Emanuel sold his Chicago home and registered to vote in Washington, he would be ineligible to run for mayor. But that’s not the case. Emanuel is still registered to vote under his Chicago address, and in fact voted absentee in the February 2 Illinois Democratic primary.

Board of Elections spokesman Jim Allen likened Emanuel’s situation to a soldier serving abroad. Military servicemen don’t forfeit the right to vote in their home state just because they’re not home to vote. Emanuel moved to Washington to serve under President Obama in a position that is intrinsically temporary, and so he is equally entitled to vote-and run for office-in his hometown.

Allen points out that no challenges to Emanuel’s eligibility have yet been raised to the Board of Elections. In the likely event that one will arise-either from a rival candidate or private citizen — Allen told Fox the board will examine Emanuel’s records and decide whether he has sufficient standing to run. And in the likely event that the elections board decides in Emanuel’s favor, challengers can then take their claim to the courts…

It sounds like Mr. Allen has already made up his mind.

We would say that Mr. Emanuel’s residency could be easily proved by just checking his tax records. Unfortunately, he doesn’t have a very good record in that department, either.

      It would be the same like what happened if a Democrat did this; in NYC, it did happen a few years ago, and the candidate was denied the seat. Google the name Mathieu Eugene.

      (He later ran again after satisfying the residency requirement and won.)

      I am waiting to hear about this from ABC/CBS/NBC/MSNBC/CNN etc. Were it a conservative, or even a republican, it would be plastered all over the media and the newspapers…and the outcry from the left would be deafening.

      This site, Steve Gilbert, endeavors to uncover the bias that exists in the news services. Note it is only FOX that discovered this, that mortal enemy of Mr Obama and his kind. But in the world of public opinion, the “mainstream” media apparently doesn’t feel it’s worth reporting (understood as: Nothing should be done about it) because the vast majority of the media is made up of left wing activists. They want to control results by controlling the message.

      So what I was stating was that socialists get a pass over tax-evasion, hiring illegals, DUI’s, divorce, infidelity, etc. But when a conservative falls, it’s microscope time and they don’t let up. They still hound Nixon, for god’s sake and the man has been dead for 16 years and out of office for 36. But we hear(d) nothing to condemn Ted Kennedy, ever from the news.

      Bias in our news system is as criminal as the socialists and what they currently do in power. Having a compliant media allows them to further their agenda with an acquiescent public. It’s not anything new, of course. I had simply hoped that when I reached middle age my “peers” who run our government would not be of the ilk I ran into when in high school. I was wrong. It’s much worse.

    If New York did not care about Hillary running for the Senate having just moved to New York and if the Democrats could care less that BHO ain’t even an American citizen, then why on earth would a little thing about residency bother a bunch of Al Capone’s relatives?

      Hilary, however, had established residency during her campaign. It’s on Election Day that one has to meet the requirement.

      As for BHO, unless one can come up with solid, irrefutable proof to the contrary—he’s a citizen!

    How insulting of Allen to equate a slimy politico hack with a soldier serving overseas. For military there is a requirement for a permanent home of record & a legal resident – you can have both the same or both different. For my husbands entire 23 years he used his Mom’s address as his phor – even though in 23 years he probably was there less than 6 months total. Always, always when the Left wants to hedge the laws – they wrap themselves in the flag and equate themselves with the military. What slime. When was the last time Rahm was at that address – oh yes prior to renting it out in Sept. possibly just by the skin of his teeth does he qualify for ‘residency? But as pointed out – when ever do the Dems care a whit about the Law – only when questioning a Republican.

    Since I hear dead people vote in Chicago – I do think this will muster any concern what-so-ever – other than the free publicity The Dancer can get to win election.

    I was thinking Tony Rezko could probably help with Rahm’s housing situation. And Rahm will be close by when he is asked to testify/plead in the Blago II trial.
