WH Confirms: Terrorists Get Mirandized

Obama Administration Says Some Detainees Overseas Are Being Mirandized — and Bush Did It, Too

The Obama administration announced this week that some detainees captured and held abroad have been read Miranda rights to preserve evidence for a potential prosecution.

Administration officials say the Bush administration did this as well in some instances relating to certain criminal cases.

They would not offer specifics in any of the cases, whether under President Obama or President Bush.

The question of detainees being Mirandized was raised by the Weekly Standard’s Steven Hayes who wrote that "the Obama Justice Department has quietly ordered FBI agents to read Miranda rights to high value detainees captured and held at U.S. detention facilities in Afghanistan, according a senior Republican on the House Intelligence Committee."

The Obama administration took issue with the notion that this was a blanket policy change, one ordered by the Justice Department.

"There has been no policy change and no blanket instruction issued for FBI agents to Mirandize detainees overseas," Justice Department spokesman Matthew Miller said. "While there have been specific cases in which FBI agents have Mirandized suspects overseas, at both Bagram and in other situations, in order to preserve the quality of evidence obtained, there has been no overall policy change with respect to detainees." …

While the actual Miranda rights differ in different states, they adhere to the court ruling that "the person in custody must, prior to interrogation, be clearly informed that he or she has the right to remain silent, and that anything the person says may be used against that person in court; the person must be clearly informed that he or she has the right to consult with an attorney and to have that attorney present during questioning, and that, if he or she is indigent, an attorney will be provided at no cost to represent him or her."

The ranking Republican on the House Intelligence Committee, Rep. Peter Hoekstra, R-Mich., told Hayes that he was concerned about this news.

"It would seem the last thing we want is Khalid Sheikh Mohammed or any other al-Qaeda terrorist to remain silent," Hoekstra said. "Our focus should be on preventing the next attack, not giving radical jihadists a new tactic to resist interrogation–lawyering up."

In March, President Obama told 60 Minutes that "the whole premise of Guantanamo promoted by Vice President Cheney was that somehow the American system of justice was not up to the task of dealing with these terrorists. I fundamentally disagree with that. Now do these folks deserve Miranda rights? Do they deserve to be treated like a shoplifter down the block? Of course not."

Can you believe that we are even talking about this?

And people aren’t simply outraged?

    Just as Bill Clinton was paralyzed with fear of upsetting his legacy by using our world-class military, Barry shows the same kind of lawyerly paralysis. And thus, we can expect the same limp-wristed approach to fighting a war or persuing our enemies.

      Exactly, PR. There are different levels of governance for the entire compass of Americans abroad: the US GI, the US civilian employee working abroad, the US foreign service official, the US member in the Peace Corps, the US church member on missionary duty in some nation…all would require a certain approach if a foreigner abroad was to harm or threaten them in some way.

      After all, when a US GI gets attacked and captured by foreigners, he or she can expect that more US armed forces would soon be trying to rescue them as part of a US standard operating procedure in that particular branch. Not so for an American missionary worker getting kidnapped abroad by foreigners. One or two of those areas may have dictated the issuance of Miranda’s that President Bush had to issue, but he didn’t inflate the areas where they were necessary, as does this scary Manchurian Candidate.

    Well, though I’m sure a lot of our boys work in law enforcement back in the states, it looks like part of training for Iraq and Afghanistan should involve being up to date on federal criminal statutes and procedure so that they don’t inadvertently give the terrorists a chance to get off on a technicality. If they have constitutional rights, this means that now they are protected from undue search and seizure, which I’m sure many of their lib lawyers will latch onto when it comes time to go to trial or bargain (Did you get a warrant to search under Mohammed’s vest or just stereotype him as a suicide bomber when he shouted “Allah Akbar!”?)
    Our constitutional rights are certainly part of our values. But rights come with responsibilities that these non-citizens who aren’t even living in our country certainly don’t share.

    I am well beyond the point of outrage. This is so crazy I hardly know where to begin.

    How did foreign terrorists and foreign combatants captured on foreign battlefields become entitled to the full blown Constitutional rights of US citizens? While simultaneously here at home in the USA, Carrie Prejean (Miss California) is stripped of her crown without so much as a fare-thee-well because she refused to knuckle under to some important local fag? Have I fallen through a crack in the universe and ended up in Justice Antonin Scalia’s worst nightmare?

    How and when did the FBI obtain extraterritorial authority? How and when did the CIA lose its authority for overseas operations? And its authority to interrogate foreign enemies? How and when did the US armed services become a police force instead of . . . well, you know, a military force? And if the military service member or FBI or whoever fails properly to Mirandize the innocent-until-proven-guilty terrorist suspect, does the suspect walk? You know, fruit of the poisonous tree and all that rubbish? And does he get habeas corpus along with his right-to-silence-and-taxpayer-furnished-lawyer? And French toast along with his morning copy of the New York Times?

    When a country slips into the final downward chute, it seems to lose the ability to look at its predicament objectively in direct ratio to the seriousness of the predicament. If that is true, then the predicament must be very serious indeed, because all objectivity has fled. At the very time when everyone should be demanding the destruction of terrorists and the elimination of the threat of terrorists armed with WMDs, everyone is concerned with just the opposite. What we get instead is the triumph of the Liberal Death Wish.

    These sicko Liberals––including Nerobama, Tigellinus-Holder, the rest of the Destroyer-crats, including in particular their co-conspirators in the media, and including the simple fools in what now passes for the American public––seem to have the Death Wish for America, and not much else.       I think libwits look at Europe, which went socialist after WWII as a model we should emulate.

      On the surface, it looks good. Europe is relatively wealthy; they don’t get involved in any wars, they have short work weeks; they all have government run health care, terrorism has been so-far controllable, etc.

      But the “looks good” ignores the looming demographic catastrope Mark Steyns writes about.

      And the “looks good” ignores the fact that we have provided their national defense for 60 years.

      And the “looks good” doesn’t consider their national debts which exceed ours by a long shot, which means their children need a miracle.

      And since the cataclysm hasn’t hit Europe yet, it is an easy sell in the US. A dishonest one, but an easy one to sell.

      I also believe that Europe believes they can buy another few decades by sacrificing Israel. And The Moron believes it too.

      In 2006, British Rear Admiral Chris Parry, who was the top strategic thinker at the Ministry of Defence, made a presentation to the Royal United Services Institute in London, at which he predicted that within 10 years terrorists based in North Africa would be attacking yachts and beaches in the Mediterranean from fast boats, and that Britain and other European countries would be undermined by “reverse colonisation” by radical Islamic immigrants.       A rhetorical question, to be sure.

      But the liberal hippies of yesteryear are running the commune and, like any highly focused special interest group, they cannot see beyond the borders of their own thinking. They still draw upon the experiences of the 1960’s, real or imagined where “the man” (that would be conservative thinkers and reasonable people) are the bad guys and thus, everything that was “the establishment” (remember that term? they used it often to describe that which would prohibit them from smoking dope everywhere and setting up a head shop on any street corner, or anything else they wanted)is to be gone against.

      They perceive that “the man” and “the establishment” were critically biased and blind to the needs of everyone, especially people most unlike ourselves. Thus, it follows that, to them, terrorists and radical muslims, etc, are to be accommodated as misunderstood and needing of, not only constitutional rights, but even SPECIAL rights…much as we have the now ever-so-popular hate crimes to differentiate from plain, ordinary, run-of-the-mill crimes.

      They are unaware of this fallacy and cannot see it if you painted it on the wall and shone a light on it. They live in denial simply because to them, everything the US has done since 1776 is wrong and radical muslims are simply another minority that “bald white men” are prejudiced against and they cannot see the dichotomy and clash of cultures, let alone basic ideologies.

      When they see a US citizen or Westerner’s remains hanging beheaded, they feel that the victim somehow deserved it for the US has created these miscreants of the world by its “unfair” treatment of them.

      They see the world as needing a benevolent caretaker…who to them is Blammo, the magic negro, who, clearly understands and is a victim himself. Again, blindness of choice for the hippy-in-power.

      And this benevolent dictator will reach out his hand and like so many of their theme songs of the 60’s the planets will align, the stars will all smile and peace will reign over the Earth.

      Many of my friends think I’m nuts for pointing out that liberals are religious zealots. Not the religion of Christ or Buddha or anything like that. But the religion of Utopia. That all the crap and drivel they fed themselves since their brains were still growing and the lack of self-critiquing and critical thinking have taken their toll and produced….Nancy Pelosi, Bawney Fwank and all the other dreamers in congress who think they can now right the wrongs of 200+ years of this nation’s existence in one fell swoop.

      The dining room table arguments that these hippies once had with their parents have left a festering sore that they wish to heal. And they’re gonna show everybody how right they (think they) are. Yet, it’s all going horribly wrong and we know it, the world knows it and the only people left are the fellow Utopians. They will never know it.

      They have spent a lifetime blaming others, being taught how to blame others and shirk and fend off self-reliance, responsibility and respect for the opinions of others.

      They will never understand the damage they are causing, that they will have caused and why it all went so horribly wrong.

      They cannot marry a concept with a practical application. If they were the Wright Brothers, they would only see the vision of being able to fly and write and sing and dance about it. But they would never suppose how to study aerodynamics, the design of a practical wing, the forces that act on it and the problem-solving to make a functioning flying machine. If anyone did, Al Gore would be there to tell them it’s impossible; That the air has no ability to allow man to fly. Barney Frank would be there to force them to make their airplane so that anyone could fly it and understand how it works. Pelosi would be there to say that flying is torture, then later deny that she even knew the Wright Brothers talked to her about it.

      It’s all about trying to appear smart while knowing nothing of which they speak. I see it all the time. I am involved in very technical training and often people ask me the most ridiculous questions, but even better, they start to explain to me how it all works. Incorrectly. They want to appear smart, savvy, knowledgeable, even clever. All out of fear of appearing stupid.

      Yet, we all know the real end result of that.

    I tried to write a long post in response to this article but it didn’t go through….so I will simply say that the left is truly delusional if they believe cookies and free computer training along with privileges given to U.S. citizens are going to keep our country safe and the jihad lovers out of trouble. These same human rights lawyers are the ones who uttered not a peep at the discrimination of Coptic Christians in Egypt, non-Muslims in Saudi Arabia, the torture of dissidents in the Palestinian territories by Hamas (eye gouging, anyone?) and rape / stoning of prisoners in Iran.

    But taking up any cause not explicitly in opposition to the American government is not a priority on the left. Their appeasement would have us coddle and surrender to the terrorists or their advocates while we go under from all the “hope and change” against the private sector.

    At least most Americans oppose bringing Guantanamo detainees to American shores. And most, unlike that tongue-in-cheek story by Time Magazine, understand that it takes more than a few sugar free cookies to placate guys who want to destroy the country.

    Isn’t it bewildering to try to crawl inside a liberal’s head, and follow along their thought processes? They feign indignation and condemnation if you suggest “my country, right or wrong” to them. It’s off to the races about the Ugly American, how nationalism has been over with since the sixties, and if I wasn’t so stupid I would know that it’s all relative, man. Makes it hard to follow when they’re so far past my linear thinking, of course. Anything you say in that conversation is going to be met with: the Indians; slavery; Jim Crow laws; etc. And you will either have to waste a lot of breath disecting their stance of moral equivalence between us and the terrorists, or you will give up.

    Having not given up yet, I find this deathgrip by Obama around the notion that it is BEST to divulge our innermost interrogation procedures and other secrets never revealed before to be nothing short of strangling the baby in the crib. Our stance against the Middle East has been put off since the 1972 oil embargo, done by OPEC in alliance against our support of Israel, which amounts to an act of economic terrorism. Add to that the more lethal acts of terrorist activities–hijackings, kidnappings, and bombings have followed for the past 35 years–and it becomes obvious that our attention to the problem has been compromised because of oil for far too long.

    When we finally begin to fight not the oil shieks and the ruling families, but the crazy lunatic fringe who control to some degree the king’s population, we are met with what seems to be operatic hues and cries from the Left. All of the “Bush lied, people died”, has seemed so juvenile and niave from the moment it went up on the MSM, but…we have actually become sidelined because of it.

    And now, we actually see a grown adult try to commit Americide. He is helped along by the conversation between regular Americans, many misguided, that goes something like this:

    YOU: Well, we sure are handing the enemy everything he needs to win this war, thanks to Obama.

    THEM: It’s international law we’re worried about. We have to follow these rules of engagement when we do war.

    YOU: Does al Qaeda follow those rules?

    THEM: Doesn’t matter.

    YOU: Really? How does that work?

    THEM: We need to Mirandize battlefield combatants we catch, so as to lead the world by example, then they’ll see the error of their ways and do the same.

    YOU: So, you have faith that the Islamic Brotherhood will reform their jihadist ways if we set the example first…

    THEM: Yes.

    YOU: But you don’t have any faith that abstinence programs work for teenage American girls.

    It is to those of you on this forum who don’t shy away from “the” conversation at work, (whether it’s affirmative action, abortion, gay marriage, socialized healthcare, etc), in church, at the grocery store…or wherever, that I drink my next Mickey’s widemouth to!
